Hello my name is Elaine Wheatley. I just bought a new home and my first payment is currently due. I put my mobile on the market though ERA Arsland Properties. Kathleen White was the realtor that represented me.
I am a single woman and have had some problems in past with men and bad relationships (being taken advantage of). Well the mobile wasn't selling as fast as I had wanted and ERA has a receptionist that fell in love with the mobile but, had bad credit issues which Kathleen said were all because of her ex-husband.
I felt bad for Cathy Gibson and knew how that felt so when Kathleen White came to me with a lease purchase agreement option so I could go ahead and buy my new house and Cathy Gibson could also get a chance to buy my place I fell for it.
Mr Booth, Cathy Gibson's Father came over to see the mobile with his wife, boyfriend of Cathy Gibson, and her two kids prior to signing any papers. He wanted to know the rules of the park so Kathleen asked me at the time if I had a copy of the lease. I told her yes and provided it.in the lease is states that you can not lease out your Mobile it has to be owner occupied. I asked Kathleen White if that was going to cause a problem and she assured me they had talked with the park manager and he had told them they would accept the lease purchase it was different since she was going to cash me out next year and she put a down payment on it with the help of her Dad.
I still had some doubts about sticking myself out on a limb like that so I asked Kathleen what happens if she defaults on the payments each month. Kathleen gave me a letter stating if Cathy Gibson did not make her payments she would take responsiblity and pay me.
With this guarantee and taking her word that she had a letter of authorization from Firlane Village Mobile Park. I went ahead and signed the lease purchase agreement and bought a new house. I moved into my new house at 9714 13th Ave Ct So. Tacoma, Wa 98444, the weekend of the 23rd of March and cleaned the mobile and had it all ready for Cathy Gibson to move in by the 1st of April.
Well, when she went down finish the final paperwork for the park they said no way this is not proof of ownership. They would not budge on the lease and said the realtor had lied about it. I received payment for april for the park and the mobile payment. They have been trying for the last month to get this resolved and get her approved for a loan or her Father.
Now that May is here I was hung out to dry and left responsible for the taxes, park, and payment for the mobile. Since she can not take possession of the property. I have put out over $1200 this month and they will not dispurse funds.
Kathleen White has lied through her teeth about what was said. She informed my attorney that I had not given her a copy of the lease and I was the one pushing to get out of the mobile and buy the new house. I can't believe the owner or broker of this company have not stepped forward and said we screwed up here or our realtor did.
We will take responsibility for her error and pay Ms Wheatley off and deal with the loan problem on our end. I am on the edge of loosing everything here and no one cares. The attorney tells me to wait until the 15th and see if they get the loan and it goes thorough escrow. I owe my new house payment now! Why should I have to wait because I trusted a company to be honest in there dealings with me.
How can companies get away with this and or Realtors. Do we as the consumer who go to them believing they are the professional have no rights to exspect them to treat us with honesty and respect.
I am very upset about this my life is falling apart around me and knowone lets me know what the status is on them getting a loan. I only have until the 15th before my new house payment is overdue.
Pretty sad not even a month and all the joy of being a new home owner is gripped away. I will probably loose everything if someone does not help. What do I do next?
