On March 9 Ms. Sharon Barnette of Capital Merchant Services came to our home to tell us about Capital Merchant Services (CMS) and what they had to offer. After several hours of her spiel and her smoking several cigerattes she completed a Merchant Receipt Form, which we signed. We were also told to sign several other documents (which we still don't have a copy of) that were blank. Her story to us was that the FDIC didn't allow documents to be filled out in handwritting and she had to take them back to the office to be typewritten in order to be in compliance with FDIC guidelines. She told us that when "her guys" came to install the equipment they would have the completed forms with them and would give them to us then.
The installation guy came and installed the machine however he had no documents and had no idea what we were talking about when we asked for them. It's been 3 weeks and we still have no documents. We have no idea what she filled in on the forms however we did find out today (3/27) that even though Sharon Barnette told us CMS doesn't charge the usual $10.00 per month statement fee nor do they charge a transaction fee, they in fact do. After speaking with her supervisor we have learned that she has filled in the the contract to her liking and we are now being charged a monthly statement fee, a per transaction fee, the machine she sold us does not work properly and we are still being charged 2.99%. And this is for a 48 month contract.in the end, we will be charged almost $5,000 for a machine and being ripped off of fees we NEVER agreed to.
We also received a letter from some company called Lease Finance Group, LLC in Chicago, IL. We have no idea who they are however they threaten that we better have the money in our account every month (for 48 months) our litigation will commence.
We have attempted to work this out with CMS but Sharon Barnette says she never promised the things she did and CMS is standing behind her. We have been totally RIPPED OFF by CMS.
