Ripoff breach of contract, did not notify in a timely manner of delay

I scheduled a move with them a month and a half ago to be here on the 2nd or 3rd of August. It says in the contract in article 3 that they would notify me in a timely manner of any delay. I was never called even with a pickup time. When I called yesterday, they said there wasn't anyone to get my stuff and wouldn't be for at least a week. That was unacceptable, as the entire pickup time was scheduled in knowledge of my flying out on the 6th. He said he'd "work on it".

When I hadn't received a call by 9am (nearly noon his time) the next day, I called again. Steven said he couldn't get anyone there and not for at least a week. When I called, he wanted a certified letter saying I was cancelling in order to refund the deposit. I did not and will not be the one to cancel, they broke the contract by not notifying me in a timely manner of a delay. Sending a letter of cancellation in the contract allows them to keep my deposit. The manager refused to give me access to the Owner of the company by phone or to speak to anyone else.
