Mr. Swate advertises that he represents you before the IRS to help you with unpaid taxes. We contracted with him over 2 years ago and paid $1800 for his "services".
Over the course of this time, he has not kept us up to date with what has been happening. As a matter of fact, he claimed to not be receiving the many notices from the IRS that we received. We have had to mail, fax and overnight this paperwork to him at our added expense. According to the IRS, they sent him copies of everything as our Power of Attorney.
At this time, we have a Federal tax lien against our home and my husband's Social Security Disability check has been levied for 15%. We did file for a hearing which has put the levy on hold until July, along with the orders to attach our bank account and garnishee my pay check.
Since Mr. Swate has not provided us with any assistance or guidance, we are ill prepared for the hearing. Mr. Swate finally did return our phone calls after the SSDI check was levied after 3 days and yelled at my husband telling him not to leave him any messages or he would not help us any more.
My husband told him he was fired and we had sent a letter to advise him of this and request a refund. He said he would not refund our money. My husband told him he was also filing a grievance with the Texas State Bar. His response was "who do you think they will listen to, me or a low life like you?"
If you read his contract carefully, you will see where it states "all fees earned as paid" which means if you are stupid enough to pay without receiving service, too bad. It also states you are only contracting with him for representation before the IRS. Trust me, he will make you so mad you will fire him also and he will have "earned" the fee without doing a thing.
