I just read a complaint against them on your website and wanted to tell my story too. I recieved a court letter that they so called served me, who ever they hired to serve me paper did not do so, they tape the letter downstairs in my hallway of my building for everyone to see. (whatever happen to privacy.)
They sent this court paper after only sending out once notice. The client is Capital One. Back in early February when I recieved my taxes, I called Capital One to pay off my balance. They gave me a number to a collection agency, they told me the no longer have the account, I called Capital One back they gave me a second number to a different collection agency, they also told me they no longer have the account, once again I called Capital One they gave me an internal number and they gave me another internal number which they had finally told me just two days before my account was sent to an attorney's office and to wait until they contact me and that I could speak with them regarding making payments or a settlement payment.
So I waited in mid to late March I recieved the letter, which I took with me out to make the phone call but misplaced the letter, so I waited for another one which came a whole month later, Friday, April 22 the same day I recieved the court papers when I got home that night.
So I had to wait until Monday to call them I explain that I did recieve the first letter but misplaced it, also I ask why was I served papers stuck to the building hallway. She said it wasn't them they hire someone to serve the papers.
Straight off the back she was rude I can't remember her name but it started with a K. She kept interupting me as I was speaking to her. Anyway I'm speaking to Ms K. About me making payments to resolve my balance, she gives me a settlement amount of $850 round about figure, first of all my orginal balance was $500, and it's not that I don't expect to pay late fees. But they are up to twice as much as the orginal balance ($1007.10)
I just explained that I don't have that kind of money now I would like to make payments she said 'this is not lets make a deal this not the collection agency' screaming in my ear, I even offered to send $200 as good faith on that day. (check by phone)
But I'm trying to explain that I cannot afford this monthly. She screaming again about this is not a collection agency. And said she'll see me in court and hung up in my ear.
I called back and ask to speak with someone else and told them how rude the previous person was, they also named her, so she must have a history of this. But she also noted in my account that I said I would pay $200 a month, which I never did say. But in still speaking to another rep they are unwilling to work with you and your budget.
Trust me I want to pay this off. I'm trying to figure out who can I make a complaint to as far as the Bar Association goes.
