Dear Mr. Engel,
I have been having a problem with a company who has basically stolen $5,310.00 from me via credit card. The company is called Phoenix excecutive group and I have been writing to a Mr. John Katzenstein regarding file number 474325, compant Phoenix Executive group.
As this company operates in multiple states, the number of people that they have scandalized remains and is extraordinarily high. I have not heard from Mr. Katzenstein in over 2 weeks, who indicated that he would report back when there has been progress made. As you may understand, this is a company that is a predatory shark that needs to be taken to court in order to determine a settlement. There are many people who have been taken advantage and victimized in the exact manner.
They are very similar to Bernard Haldane in that they position themselves as a Career consulting firm and not an employments agency. However I have been told that due to consumer law they must have indicated a clause which allows the client (or victim more accurately) in 8-10 point Roman pitch an area where they are able to back out of the contract.
Since I do have a copy of the contract but do not have your fax number I cannot fax it to you at the moment. However there is on-going legal action that has previously occurred in New Jersey, and from what I understand, there has been previous action taken in Westchester where they have an office in Purchase, N.Y.
My contract was good for 3 years, which they broached, because I always kept in touch with them via mail, phone or email. However since I started complaining a year ago roughly, I have not been phoned, emailed or called, however I have made attempts to contact Bart Gerardi without success or return phone calls.
I am asking for your assistance sir, because I am far from well off. I had to bring my wife in with me for the final meeting at which point, contract was signed and fee was arranged. However, my wife will attest to the fact, that verbal promises were made by the President of the company, Mr. Joseph Kran on job promises because of back office connections that they had. I was also promised contractual work almost immediately upon my arrival till a full time job with benefits came thru.
When I tell you that I received absolutely ZERO value in return for my time and contractual signing, I mean that not one job lead generation, phone call, meeting, letter was ever sent or communicated to me from a company that I worked with or thru under advice from Phoenix Executive Group. I never got a single job offer either and my meetings were spaced further and further apart as a result of their lack of ability in advising me to get a job.
The entire fact that the company violated consumer law should be entirely sufficient to warrant my entire refund of $5,310.00 which was billed on a credit card, to which Joseph Kran never provided me with a receipt of after swiping it thru.
These are some court cases which have been settled in New Jersey and I am aware that there have been cases settled in New York as well.
Perhaps your office would be willing to work with the Honorable Peter J Barnes, local Assemblyman for Edison area?
He is a very good contact for victims of Phoenix Executive Group in general; he is in New Jersey and he is Vice Chair of Consumer Affairs, & here is what he is working on:
A1117 Revises provisions of the consumer fraud act. (PEG is in violation of this act, maybe he can have it amended to protect other's from falling victim to this industry)
A1454 Requires certain contracts and warranties to be printed in at least 10-point bold type. (This is where the right to cancel comes in, I confirmed with Consumer Affairs, PEG MUST have this on their
contracts, pull your contracts keep in safe place)

I ask you sir, for you assistance in this matter because I am not the only victim, but in order to receive a refund, you must take them to court. Perhaps you could assist in this matter in securing an attorney to represent a group of us in New York and New Jersey? They need to be shown that we are serious and that we are willing to take them to court as necessary.
