Stub Hub
Violated their own terms and conditions

I would first like to state that I have always had a great experience with stubhub up until this situation. On Monday August 22 we purchased 4 Broncos season tickets on Stubhub, and at quite a steal for $500 total we figured why not, if we don't get them someone else will. Ok so at this point it is just a pipe dream, even though Stubhub's Terms and Conditions state that ALL SALES FINAL.

The sale went through at 5:30 pm, and was still pending. On the next day, the 23rd at 12:50 PM the seller confirmed the order.

At this point we are excited and thought well maybe it is an ex wife selling her husband's tickets. At 11:12 PM, that same night, the seller prints the FedEx packing info and at 1:27 pm on the 24th FedEx picks up the package.

The seller had to have assumed that he messed up, because I get a call later stating that the seller obviously mispriced the tickets and the order had to be cancelled. Now on the terms and conditions it states that the buyer has the option for comparable tickets, or a refund. Stubhub asked me what I wanted and I said I want the tickets I bought, it is not my fault he mispriced them. They said they could not find comparable tickets, which there were just not in price. They requested my permission to cancel the order and I stated on tape, that I absolutely do not consent to them cancelling the order, and what do they do they cancel the order. As a way of saying sorry they send me a $200 gift card, but have yet to refund my money to me.

I called customer service and asked them if I mispriced my tickets and they sold can I cancel the order? The representative informs me that "unfortunately, no, because once you confirm the sale you are in a binding agreement and by cancelling you would be in violation of the terms and conditions.": I than explained that this happened, but I was the buyer and all she could say was "well I don't know what to tell you." I called customer service several times with no help what so ever and spent hours online looking for help. While I was searching, I come across lots of horror stories from sellers claiming they were charged thousands of dollars to buy replacement tickets for customers. Because of the fan protection guarantee. Which long story short if you don't disclose proper information such as non alcoholic section or obstructed view you are liable to pay for the gift card they provide, sounds shady but whatever. This customer should than in my opinion be obligated to sell me the tickets, or cover the difference in replacement tickets right? Here is where it gets even better. I log in to my account and there is the tracking information the tickets should arrive Friday before 3:30. What for real? Well no the seller calls FedEx to cancel the shipment. I see FedEx drive right in front of my house with what I assume to be our tickets in his truck. Well I have contacted corporate and have not heard back. I contacted the BBB and filed a complaint as well as our local consumer rights advocate. I also spoke with someone from the Broncos who informed me that the only way season ticket holders can sell their tickets is if it is through the NFL Ticket Exchange, other than that they are forbidden from selling their tickets and if they do, they can lose them as long as their rights to future tickets. So that is my story.
