They said would ship an item in 2-3 days but ups never recieved item On-line

In january i ordered a Nintende Entertainment System and i paid for it and they even confirmed i paid for it. They said it should leave their warehouse in 3 days sent via ups... Ups never recieved the item. It now has been almost 4 months and still nothing. I am prepared to take legal action because i was ripped off 35 dollars
