Loan Cancellation

Recently I call BOA to see if I qualified for an equity loan. The account representative stated that I should do a Home Refinance. He preceded to advised me on the refinance leaving out some very important details. He stated that I could refinance and get my equity paid back ($6000). I advised him my credit was not in good standing and I had debts, he advised me since I had a VA Loan this information would not be checked. The application fee was $400. When I finally received my "package" I signed the required paperwwork and faxed it back. I then received a e-mail from a different agent she wanted various of different paperwork, including me paying off all bad debts and get my credit report cleaned up—I was to do this in 5 days. I then reviewed all my papework only to find out that the previous mortgage representative had move my loan off VA to conventional. I would have never tried to refinance if I lose my VA Loan and my bad debts would have to be pif in such a short time. When I attempted to contact the mortgage representative, he avoided my calls for two day. I e-mail him after two days he finally sent out a sacrastic e-mail stating the "Great State of Texas" does not allow veterans to Cash Opt on VA Loans and that is why he changed the loan to conventional. I again tried to response by telephone to no avail. I again e-mailed him that he did not properly disclose the loan information, I wanted to stay on my VA Loan and to not take the $400 application fee because of non disclosure. The next day his supervisor called. An extremely rude and irate young man who would not let me or my wife say anything and kept talking over me. This "supervisor" at the end of the telephone call stated he would cancel the loan and no take the application fee. Needless to say the application fee has been drafted from my bank account and I want it returned. I have made my mortgage payments for 14 years and expect fair treatment. I have again left messages both e-mail and telephone and only received a short rude email from the orignal mortgage representative stating the loan has been cancelled and basically out of his hands. More e-mail and more calls were made yet no one has responded. I want the application fee returned ASAP.
