I am in the process of buying a Fannie Mae foreclosure. The offering price was agreed upon along with 3% closing costs. The appraisal came in lower and Fannie Mae agreed to the lower price and still 3% closing costs. Both buyer (me) and seller (FM) signed the amendment. A day later, FM sent another amendment saying they agree to the price, but no longer included closing costs. This cannot be legal, I am prepared to file a breach of contract claim. Any advise?
