Avoid this unprofessional Landlord if you ever want your security deposit back

Bernic Enterprises (Tel: 516-627-6200) has been holding our security deposit for almost three months now.in the process, Bernic and its employees behaved in an unprofessional fashion. Bernic owns the buildings associated with 121 E. 12th. St. And 1315 First Ave in Manhattan.

This grievous situation has compelled us to write this review in the hopes that future consumers and tenants will be better served by Bernic and that we may finally collect on the deposit due.

We have complied with all lease-termination duties including a "walk-through" of the apartment, in which Bernic confirmed no restoration deductions can be claimed.

The apartment was left in an impeccable condition and Bernic didn't claim any deductions. I have called Bernic at least twice each week starting one week after we vacated our old apartment on July 14.

First, Bernic's employees told me that they can't send me a check of the deposit as Mr. Slavko Bernic, the principal of the company, had left for a three-week vacation without signing enough checks.

Five weeks after we moved out, Bernic claimed that the reason we hadn't received our deposit was that we hadn't paid our last month's rent. After I provided proof (check number) that we indeed had paid our rent, another reason for the delay was brought forward.

This time, Bernic blamed the bank for not having transferred our deposit out of the escrow account yet. Bernic claimed that this request was made in July. Throughout the entire time, I had called Bernic periodically. I was promised that someone would call me back - which in seven weeks never happened.

I spoke with Mr. Slavko Bernic myself. He said that there is nothing he can do and that it is the bank's fault. After I told him that this is unacceptable and that his company has been holding my security deposit back for seven weeks, he hung up on me without responding.

UPDATE: As of January Bernic Enterprises still owes $60 in key deposits - eight months and numerous phone calls and emails after we moved out.
