Rewards deadbeats for not paying child support on time! Ripoff They have the system set up in deadbeats favor not the custodial parent

Phownix Arizona Dept of Economic Security has their system set up to reward financially a person who is paying child support if he or she doesn't pay timely.

Its one of the ways they collect the welfare that is payed back. I found out the hard way. Even if you are not on welfare you are stuck with them and their bullshit. My exhusband didn't pay any child support for six years after our divorce so I had to take him back to court for contempt. The judge awarded me a $12,000.00 judgement for child support arrears owed. Okay too bad from the payment history that wasn't the correct amount, something you figure you can trust them with.

No, you have to do your own math if you don't want to be screwed by them not getting the amount owed correct. Okay that judgement was in 1989. Then in 1996 we went back to court for contempt again. I was awarded a judgement for $6500.00 that second time. They added correct this time I wasn't screwed out of a couple thousand dollars.in the meantime I had to go on welfare for six months in 1995. Well I payed it back and let me tell you how it was payed back.

My exhusband never paid his child support on time and he missed alot of months every year. He would miss three months of child support then pay four at once. He had been ordered to pay two hundred a month child support and one hundred more for the first judgement payoff. Well when he paid the four months at once DES would take three months to pay back the welfare and I would get that current months support. They claimed they weren't taking the money from me they were taking it from my ex. I said I was the one that missed three months of child support not my ex. And they said they don't look at it that way they see it as he paid extra that one month. Nice huh?

Well after the welfare was paid off and I owed the state nothing I still had to deal with them instead of a real judge. My ex continued to pay when he felt like it and I received one other judgement for $963.00. I just found out I received no interest on missed or late payments. What they did was when he missed three payments then payed four at once they applied three payments towards an interest earning judgement but applied no interest on the missed payments. Nice huh?

My advise to anyone is this never go on welfare and once your ex falls behind one month get downtown and file contempt on them. Only when you file charges does the interest start on arrears. Also ask the judge right then and there to put interest on missed and late payments or you loose it. And make sure you do your own math on what was missed or owed they won't. If I had filed that first year of no support that first judgement would of started earning interest then instead of six years to late.

Sincerely,

Cindy
