Texas Workers Compensation
Ripoff screwed others too, Texas uses backwards OLD screwy laws

Folks, I don't know where to begin. I wish I had had a crystal ball before I was injured in the State of Texas. Had I had one, I would have not chosen to be here. Their laws are so screwy and for the insurance company it's sickening.

Being specific, first the Workers Compensation as we all know after a certain point uses "designated doctors", and we all know, they are a joke, to say the least. Well how's this for a joke... These so-called doctors most of them are NOT even held to the utmost standards of the AMA. That's right, they are not held to the "ethical and training" standards of the AMA (american medical association).

So, how does that effect all the injured workers? Think about it for a moment. If a doctor is not held to the "standards" then he can get away with anything, after all the Workers Comp commission says he caries "presumtive weight". Presumptive weight for what the insurance company and being not current on the latest medical problems we are all having? So, who benefits? That's right, the insurance company!

The solution to this problem would be to REQUIRE that ALL DESIGNATED DOCTORS be registered with the AMA.

Will this happen? Of course not, the insurance company is in for the all mighty dollar and really don't care about the injured worker.

This is a potential problem with all states that give their so-called designated doctors "presumptive weight". What we call all do about it, is to write to our local governments and tell them what is going on (as if they don't already know) and see if the requirements can be changed for their "designated doctors".

Potential outcome if the "designated doctors" were REQUIRED to be a member? BETTER TREATMENT by better QUALIFIED doctors. Why? Because they would have to be held accountable for their actions, pay a fee to join based on their so-called speciality and take more CME (continuing medical education) in their speciality.

Why this WON'T happen. The insurance company would stand to lose more money, because the injured worker's would be treated by better qualifed doctors and the so-called impairment ratings would be more realistic.

I am a victim to this just as others reading this. Again, if I had known this was going to happen to me, I would not have been injured in this god forsaken state, they don't take care of you. Now, that it has happend, I can't move or all benefits will cease. I have read MANY of the contested case hearing results, and by damn, if you move, you are SOL. So, not only was I injured here, if I want to continue to fight and receive any type of compensation, I am stuck here.

Texas needs to come up to the standards that other states in the Union believe in and adhere to. Texas is so far behind, maybe the North should have taken over. The Northerners are far better in taking care of "family" issues and their people that Texas could ever think of being, and believe it or not I am a native of this crappy state, but can't move or I will loose all benefits. That's really sorry.
