Please find attached below the following events between Chantina Designs and JAG Apparel:
October 10 - JAG Apparel emailed Chantina Designs with interest in representing my children's clothing line. Julie Glidewell of JAG Apparel forwarded her credentials. There was no mention of keeping the product when the contract ended. A six month term was agreed upon for $600 with a commission rate of 12%. Chantina Designs agreed to have JAG represent her from January 10 through June 10.
December 10 -Email sent to JAG indicating Chantina Designs was making several coats and hats (11 specifically) and would send them with $600 after the first of the year. December 28 - Several questions were answered by JAG prior to shipping. PLEASE NOTE: At no time did JAG ever mention they would keep the samples after the contract ended or she needed a sample of every coat and hat.
January 7 - JAG sends email with all the shows Chantina Designs would be featured. January 10 - Agreement signed by Chantina Designs and JAG - Agreement states "JAG Apparel group will retain all shipments received from the Company" - Interpretation of Chantina Designs is that JAG would hold the samples during six month contract.
January 17 - Email from JAG stating coats, line sheets and postcards arrived.in JAG's response to Better Business Bureau, JAG states they never received line sheets and breached our Agreement, yet her email clearly proves she did.
January 17 - Receipt for $600 received via PayPal.
February 4 - No sales as of yet. No mention of keeping eleven coats and hats. Sales are slow due to weather per email from JAG. JAG asks for more coats in February 4th email. Chantina does not produce them because of lack of sales.
April 2 - Still no sales and no communication from JAG.
May 3 - Another email looking for an update to no avail.
May 5 - Finally hear from JAG. Reason for not responding is Easter vacation, tornados and air conditioner damaged while on the road. No sales to date. No mention samples would not be returned end of June.
June 22 and August 2 - Additional emails looking for update and asking to ship my samples back as the contract expired June 10.
August 8 - JAG informs me they do not return samples - First time I have heard this from JulieAnne.
August 8 - Email to JAG asking to return my samples and to resolve matter amicably. No response.
August 24 - Complaint filed with Better Business Bureau. JAG responded with one false statement after another.in my followup response to the Better Business Bureau, excerpts were cut and pasted from actual emails to substantiate facts and prove statements from JAG were false and defamatory. JAG further stated I breached our Agreement by not giving a 60 day notice. Our contract ended June 10. My request to return my 11 coats was dated August 2.in conclusion, JAG provided false representation by never indicating verbally or in writing they would keep my samples. No other clothing sales representatives throughout the country keep samples. I have signed on with numerous sales reps and this is unheard of to pay a showroom fee of $600, plus commission of 12% and get to keep your coats. I feel that I was intentionally misled by JAG who in turn produced no sales and refused to return my coats and hats. I feel swindled by JAG Apparel Group, in particular, JulieAnne Glidewell.
I ask for your assistance in getting my belongings back or having JAG pay $1350, the amount in which I would have made upon sale of the items. I look forward to hearing from you.
