M/s GLOBAL SOURCE Exhibitions & Events (India) Pvt. Ltd. Is into conducting, organizing and arranging the Exhibitions and events. That company has plans to arrange one such Exhibition in November in Mumbai and as a Indian Registered company wanted to participate in the event. That accordingly on 27th July Mr. Khushroo Bhadha, The General Manager of your Company came to my office to meet and to understand nature of the business and was very pleased with concepts and said that this show will give great financial benefit by exhibiting products.

On the basis of the assurances given by Mr Khushroo, I expressed my desire to participate in the said event and on 28th July Mr. Khushroo Bhadha the General Manager of your Company mailed me stating that we had a choice to exhibit in any hall i. E Machinery & Industrial Supplies Fair (MIS) or China Sourcing Fair (only non Indian companies can participate in this CSF) and your company would be fine with any option selected by me.in reply to your mail dt 28-7 I wrote back to Mr KHUSHROO (General Manager) and MR SHISHIR LAHOTI (National Manager-Sales) and Mr. DEEPAK THAPAR (Telesales Supervisor) that your salesman Mr. Deepak Thapar encouraged me for booking in the Indian hall, booth 5D23, and my client readily agreed for the same.

2. On 30th July Mr. Khushroo Bhadha The General Manager of Company sent a Global Source Salesman, Mr. Deepak Thapar to my office early in the morning to close the deal. Mr. Deepak Thapar knew exactly the nature of the business of and he said excellent and also said that we will get great response. Mr. Thapar also said that, since we had paid in advance and in full, we will get 5 items to post on their website for free.

Relying, in good faith, upon Mr. Deepak Thapar’s assurance and representation that your company is well-experienced, equipped with proper expertise / resources and further that their company shall provide best quality booth, we agreed to entrust upon their company and we signed a contract and gave Mr. Deepak Thapar a Cheque in favour of Global Sources in advance for the full amount of Rs. 1,09, 197/- (Rupees One Lac Nine Thousand One Hundred and Ninety Seven Only) for the 23rd to 25th November show. Mr. Deepak Thapar also provided the Booth no. 5D23 for us.

4. After signing the contract we had started preparation for the show and spent time, energy, efforts and money. We had printed 3000 Flyers along with the Booth number, 1000 Questioners, 3000 Business Cards, 3000 Key Chains, 500 T-Shirts for the customers of the show and incurred approximately Rs. 1,75, 000/- (rupees one lac seventy five thousand only) till date.

5. We were shocked that on 7th September now after 39 days of the contract, we received a call from Mr. Khushroo, breaking the bad news to us that - we cannot exhibit in MIS hall i.E. The hall selected by us due to the internal matters which he can not disclose to us. We also received a mail from Mr. Khushroo apologizing for the inconvenience caused to ust and stated that they are not able to allocate any booth for us in Machinery & Industrial Supplies Fair (MIS) hall. He further stated in his mail that we were left with two options, either he takes the refund of the entire money paid by us or we can accept the booth in China Sourcing Fair Hall (CSF) which is meant for only International Exhibitors.in the beginning i. E in July your salesman Mr. Deepak Thapar encouraged us for booking a booth at the Indian hall i.E. MIS hall booth no. 5D23 and the same was seconded by Mr Khushroo and now he himself in giving contradictory statements in his mail to the earlier wherein he had given to us, a choice to select the hall. Now how Mr. Khushroo is telling us to take a booth in CSF hall (which is much more expensive) to pay extra approximately Rs. 1,00, 000/- (Rupees One Lac Only) for CSF Hall. This has caused a lot of mental tension as well as monetary loss to us.

At this point, we had already paid money in full for the selected booth in MIS plus spent Rs. 1,75, 000/- (RUPEES ONE LAC SEVENTY FIVE THOUSAND ONLY) for printing of 3000 Flyers along with the Booth number, 1000 Questioners, 3000 Business Cards, 3000 Key Chains, 500 T-Shirts for the customers of the show and how their company change the stand at the last minute, we don’t have that kind of money to book a CSF Hall with extra cost even if their company gives a booth to us in CSF for the same cost, their company policy does not allow Indian company to hold the stall/booth as CSF. Now we had not left with other option, but not to participate in their show, so we request to refund the money paid by us Rs. 1,09, 197/- (Rupees One Lac Nine Thousand One Hundred and Ninety Seven Only) and also pay Rs. 1,75, 000/- (Rupees One Lac Seventy Five Thousand Only) towards the expenses incurred by us for the show and also pay Rs. 5,00, 000/- (Rupees Five Lacs Only) for the mental agony and Rs. 5,00, 000/- (Rupees Five Lacs Only) for the loss and damages caused or suffered to us we would have made a business to the tune of Rs. 5,00, 000/- (Rupees Five Lacs Only). Therefore the total claim amounts to Rs. 1,09, 197/- Rs. 1,75, 000/- Rs. 5,00, 000/- Rs. 5,00, 000/- = Rs. 12,84, 197/- (rupees twelve lacs eighty four thousand one hundred and ninety seven only).
