I was contacted by an Agent McCollough. On 7-15-11 with the message that I may be sued for fraud.
The Facts: I had signed up with Bally Fitness in late 03 or early 04.in late April 04 I went through a drastic life change. Spent time in homelessness. I did not fully recover until March of 08. I now live on SSDI and a small VA Compensation. I called Agent McCollough to find out what this was about. He was quite the unpleasant person. Threats, attempt to intimidate ETC. I am not a push over. When he said his report would reflect my refusal to pay, not my inability to pay when forwarding to the Lawyers, I told him that It was not possible to get judgement on SSDI he got nasty and hung up on me.
I immediately Googled "Breach of contract statute of limitations" and found that in CA. It was 4 years, and where I am now 6 years.
I called Agent McCollough and told him that he and his Lawyers were SOL. My next step is a complaimt with the AG in my state
