Parking Ticket for Street Sweeping when were Streets being Paved! Otc 10.3.1

On Wednesday, April 20, I was cited for parking on a public neighborhood street under City of Oceanside Code (OTC 10.3.1) - a violation for no-parking zone due to street sweeping day. However, the ONLY reason I was parked on the public right of way, was because we prohibited from entering within 2-3 blocks of our homes and driveways due to STREET PAVING.

I concede, this particular day, the 3rd Wednesday of the month of April was, indeed a designated street sweeping day, but for the prohibition of access to our homes and the street paving I would have been parked in my own drive way and not received the ticket. Furthermore, the closest parking would have been 1 mile away (well. 9 miles away).

It seems to me logic and reason would follow that on a day the City Administrator, Engineer or other authorized Director of Publc Services should have the foresight to: (a) cancel street sweeping on a day the streets are being paved in a dsignated neighborhood saving the City money, or (b) allow resident street parking on accessible streets adjacent to the streets being paved since residents do not have access to their driveways thus FORCING them to park on city streets, or (c) having the foresight and wherewithall to NOT schedule paving on days street sweeping is designated.

Now, I must pay $58... Part of it is my fault since I missed the deadline for contesting the citation due to misreading the citation; I thought I had 29 calender days which is the time stipulated to pay the fine (dumb mistake, I know). I am still planning to send the letter contesting the ticket along with the fine... But I will also forward it to the local newspaper, Turko Files and post on sites such as these, especially becasue it has been known that this type of ticketing happens often and the City of Oceasndie seems to be on a roll ticketing residents for technicalities resulting is resident's angst, resentent, loss of respect towrds City government, alientation and a belief there is corruption od sorts to "pilfer" money for residents for unreasonable, illogical and/or technical things... Where had common sense gone???
