Property Lien

I bought a home in Mesquite, TX and closed on October 21st.in good faith with hard earned money saved over a period of time.

The property was a HUD property and owned by the United States Federal Government till the date I closed.

The title company ran title searches and the property cleared any and all liens against the address at 3321 Aquaduct Court, Mesquite, TX 75181

The city of Mesquite violated the trespass laws set by the Federal government on HUD properties and mowed the property on September 30. I was unaware of this charge till the refusal to have my water turned on.

After several phone calls and e-mail attempts I did finally get someone who allowed the water to be turned on due to the family situation. I am allowing my daughter to move into the property for her and her young family.

The lien still stays in place and the city will not eliminate the lien. It is attached to the property and the city of Mesquite is holding me personally responsible for paying a mow lien of $163.08.

I have spoke to Southwest Alliance who is contracted to handle HUD properties and they are advising me NOT to pay the bill. The Federal Government agrees with me that the city of Mesquite needs to release the lien.

I did not own the property on September 30 so I contend that I have no legal obligation to pay for services that the city chose to do; even violating the trespass law.

In the end if I do not get a clear lien I will file a suit on the city of Mesquite asking for damages, loss of work, and time dealing with this situation, attorney consultation fees, and for undo stress.
