Morgan Stanley Home Loans Fraudulent Foreclosure by Saxon Mortgage

In or about May through July Morgan Stanley Home Loans aka Saxon refused to provide timely documentation to my husband for his 401 K Hardship Loan requirements in order to make current his home loan.in fact, my husband made numerous contacts with Morgan Stanley Home Loans (Saxon) Customer Service Department and each time spoke to a different representative who knew nothing about this request. Further, on one of my husband's contacts with the customer service department, he was advised by the representative that Morgan Stanley Home Loans did not want his money as it would stop the default/foreclosure time clock. This representative informed my husband that if they accepted his money, that they would take our house regardless. Although not named on the loan documents but a legal owner of the property, Morgan Stanley Home Loans (Saxon) failed and refused to notify myself personally at any time of this impending foreclosure and sale of the family home of 16 years. Morgan Stanley Home Loans had full knowledge how to and the ability to make contact with myself (work phone, email and cell phone) and failed and refused to contact myself. It was not until the weekend before Thanksgiving 2009 that I learned that my house was sold at auction. I have made numerous attempts to allow Morgan Stanley Home Loans to correct this deceitful act going as far as speaking with their CEO, Anthony Meola. Mr. Meola refused to deal with the situation and forwarded my complaint to his assistant general counsel, Andrew Cline. As it goes, my family was served with an Unlawful Detainer Complaint, had to appear in Superior Court of California and was forced to move by the Los Angeles Sheriff's Department from our home of 16 years. We have incurred substantial legal fees, moving expenses and not to mention extreme emotional and physical distress of myself, my husband and my ten year old son.in conclusion, Morgan Stanley Home Loans (Saxon) never offered to modify our loan terms or accept any payment on our mortgage or notify myself, a legal owner of the property. Morgan Stanley "ramrodded" our home into foreclosure and sale. The home was unlawfully and fraudulently sold at auction in Nov. 2009 for $404,000. At that time the amount due on the mortgage was approximately $350,000. The home again was sold in July for $579,000. Morgan Stanley (Saxon) has unlawfully and fraudulently stolen our rightful equity in our home in the sum of $229,000. Morgan Stanley (Saxon) has failed to redeem our rightful property or pay for our equity in our home in the sum of $229,000.
