Brendan, Per our conversation on Friday, June 4th. You put $7,024.23 into my checking account and First Data Services is holding $5612.00 for 90 days for charges, that may come back. I find it unfortunate that you have not told me the truth about this account or what is going on from the first time you phoned me. 1. You have not been able to provide me with the name of the client whom you said did NOT approve the charge on her card. Yet we have called every client and everyone is happy with our service. Im really not clear on the FIRST DATA SERVICES business model, who is your client? I tried to refund the clients money and I know that I asked you about it on the phone during our conversation on May 27th. I said let me just return the remainder of the clients money. You assured me that this would not be a problem. I did not hear from you for several days so I decided to go into the site and try to refund the money to the remaining 7 clients. I left you a message on June 1st that I had refunded the money and you confirmed that by a message you left on my machine that the money was being returned to the clients on June 2nd and you could see the refunds went through. 3. On Wednesday June 2nd, I receive an e-mail at 9:00 P.M. From PayByWeb as follows:

On Wednesday, June 02, while attempting to settle a batch of transactions for your payment gateway account, the system encountered an unanticipated error. This error prevented the batch of transactions from being settled. 4. On Thursday, June 3, I leave you a message relative to the problem with the account and what I was told by PayByWeb when I called them. 5. After several calls to you, on Friday, June 4th we talk about the account and you tell me that you have refunded the money to the clients that were done on May 26. I have receipts that the money was refunded and it totals the $7,024.23. You indicated that First Data will be holding the $5,612.70 (the remaining charges) for 90 days to see if there are any chargebacks. This was all news to me, the story significantly changes here! Later that same day, June 4th, I called you to explain to me what charges First Data was holding back so I could explain to my clients what had transpired. You told me that you dont do it like that it is by batches and you could not give me a break down. Can you explain to me why First Data is attempting to withdraw $5,930 from my checking account that I do not have if you have the clients money on hold? I have no complaints from clients and no chargebacks. After researching First Data Services on the internet, I found that the Complaints Board has literally 100's of consumers who you have lied to and treated the same way all in the past couple months! They have asked all consumers to: Submit your complaint to the FTC. It is very important... Https://www.ftccomplaintassistant. Gov / I have closed my account with First Data because you asked me to send you a fax stating that I was closing my account. Therefore, you have no further right to go into my checking account to withdraw money. You are already holding back the charges of $5,612.00. I need an explanation as to what First Data is doing with the remaining money, when it will be returned and who the money belongs to and I would like it in writing. Thank you. Well that's my letter but according to all the other complaints it will take alot more than this for them to comply and nobody is getting anywhere with them?
