I got a used pick-up truck from a local dealership in Laverne, CA. However, since I have had Drive finanical services obtain the loan on the vehicle, I have been daily harassed at home, work, my pager - there were somedays that I have received over 12 calls from the company in one day alone stating that I must return their call immediately or your vehicle will be repossessed.
Other times I have spoken to them and made arrangements to get payment to them, one person would approve it, and then the next would say - the weekend people don't have the authorization to extend that kind of credit extension.
Everytime I have called to speak to the particular person who left the message, they are never available - and they stated how can I help you and who am I speaking to.
The are always confirming your name, address, home phone, work phone, cell phone, insurance verification, employer etc. At every single call you make to their offices. When you have already given this information when you purchased the vehicle loan from them. (I can see this confirmation occassionally - but not every call) don't they document this information on their computers? Or do these people not document their conversations etc?
I have been in collections for over 20 years, and the tactics that this company is using is against the Business Civil Codes and collection procedures. They are stepping over their bounds on numerous occassions, and I really feel that someone needs to put a stop to this. I advise you all to let them know about the "do not call" Registry that went into effect in October.
Yes, this is for solicitors, however are they not soliciting you to make payments? This may stop them from calling you constantly. If you decided to file bankruptcy on these people for any reason - beware of their tactics as well as AmeriCredit/People First.
They are pulling the same tactics that Drive Services is pulling, and they will not reaffirm on your account, they zero out your account stating that it was paid in full and that you can sell your vehicle, refusing to send you a statement, refusing to send your title on the vehicle, then repossessing your vehicle even though you have signed a reaffirmation agreement in your original bankruptcy papers.
Then on top of that filing Civil Lawuit against you in court to recover a vehicle that they already repossessed. All these tactics are illegal. Let no-one tell you there is no grace period. Their web site states there is none. I have been doing legal research and under Business Code sections they are required by law to give you a grace period (All companies do including credit card companies etc.)
So, let's get these guys and see if we can get money from them for the pain and suffering, emotional distress and financial hardship that they may be causing because of loss of jobs because they continue to call you at work and harass you.
