This in regards to a health club membership in which abc financial is responsible for the automatic monthly bank drafts. My contract staes in order to cancel the membership, i must provide a 60 day written notice to abc financial. December 0f i mailed a written letter to abc financial informing them of my cancellation. I was then billed for jan/09, feb/09, & mar/09. I then cancelled my credit card which was on file for the automatic bank drafts. I then began receiving lettres from abc financial in april stating they need updated account information. Subsequently i began receiving letters of amounts owed, with the most recent being in may/09 for $108.50. This letter aslo stated that a payment of $35.00 will be due in june. I contacted abc financial and spoke to several people including 2 supervisors. I informed them i sent a cancellation notice in dec/09 as my contract states. They told me that they have no record of it and that i either need to show proof i sent it in or pay the balance. The letter was sent in first class parcel post, therefor ther is no possible proof on my end. After researching the internet for abc financial, i found hundreds of complaints of the same nature form people all over the country. Thgis sounds like a common practice for abc financial to say they did not receive a cancellation. Furthermore, after speaking to the owners at some of the local gyms, they say this is a common scam of abc financial. Abc financial informed me today that they have turned me over to a collection agency, however could not provide me with the company's name or contact info. I feel that i did what my contract requires me to do and it seems too peculiar that abc financial states they have no record of my cancellation notice; consistent with all other complaints filed. Abc financial has over 600 complaints filed with bbb-arizona for similar issues.
