Ken Brewer, Rick Case was unable to approve me for a car loan and kept my deposit

In December I went into Rick Case Mitsubishi to purchase a car. I was told that I had some credit issues but that they would be able to get me approved. I signed the papers and gave them a $1500 down payment to go toward the purchase of a car. About a week later I received a call from Ken Brewer, Finance Manager, to say that the lender was having trouble with my approval because I was working through a staffing company and was considered a temp. I told him that this was a full time position and that I would be going permanent very soon. Ken Brewer said that he would get it worked out. I continued to drive the vehicle. About 2 weeks later he called back to say he was still having problems. I asked him if I should bring the car back and he said no, he would get it worked out. A couple of more weeks went by and he called me again to say he still could not get approval and asked if I could get a co-signer. I said yes, that my brother would co-sign and called him back with all of my brother's information to add to the loan. Se at this point had still not cashed my check for the down payment.

Another couple of weeks went by until the paper work went out to my brother. Once my brother signed and sent his paper work back I went back to Rick Case again to sign the paper work; this was the 3rd set of papers that I signed. At that time I wrote him another check for $1500 dollars. Two months had now gone by as this was on February 11 & I was still driving the car per Ken Brewer's permission. While in to sign the paper again, Ken Brewer assured me that this was absolutely the last step and that everything was fine and that I would not hear from him again on this issue.in the mean time, they deposited my check and the money was withdrawn from my account. On Feb. 23 I received another call from Ken Brewer stating that the bank had sent the loan back to them requesting more information from my brother who had excellent credit. I had already submitted his driver's license and utility bill as proof of residence when I signed the papers for the last time and was assured that nothing else was needed. The new request was for a phone bill from my brother. I told them at that time that my brother worked for a company who supplied all of his phones and that he did not have a phone bill in his name. Ken Brewer said to get a letter from his company stating this.

My brother works for a large communications company and this is not something that they would do. So now here we were again after almost 3 months still trying to work the financing out on my car. At this point I was beside myself. I contact another dealership who not only had a better deal on a car but was able to approve my loan within hours with no problems and in my name only. I only had to provide them with my driver's license, utility and phone bill and my hire letter as I am now on a permanent status with the company I work for and am no longer a temp. The whole process with the new dealership took only a couple of hours. Now, I still needed to put down $1500 dollars so I called Rick Case back to let them know that I was no longer interested in buying their car as my brother could not provide their request and asked for my down payment back. The manager of the dealership said no, that I would not get my down payment back. He said that I would need to bring the car back or they would send a truck to pick it up. He was extremely rude and not compassion to what his company had already put me through. His solution to getting the phone bill from my brother was to have him go out and get one of these pay as you go phones. I feel that I had provided everything that they had ever asked for and even took valuable time off from work to sign the 3 sets of papers in addition to the numerous interruptions at work to discuss this with Ken Brewer. If another dealership could get me approved in a matter of hours then why could Rick Case not? I feel that I have been scammed through the whole process. I hope this keeps other consumers from making the same mistake.
