It was the year 2006. As if having my life regulated for previous 13yrs and financially destroyed wasn't enough. The first garnishment came in 1994 for $3,000.00 that FOC deny's ever happening. Friend of the court went into my business bank account and took every dime. I was sued by my suppliers and forced into bankruptcy.
The xwife and friend of the court formed a partnership to destroy me. For 15yrs I have been kept down to the poverty level and on several occasions made an example of by the growing State organization known as Wayne County FOC.
Governor Granholmes signed the bill making it a felony for parents ordered to pay support known as MCL 750.165 Sec. 165. (1) If the court orders an individual to pay support for the individual's former or current spouse, or for a child of the individual, and the individual does not pay the support in the amount or at the time stated in the order, the individual is guilty of a felony punishable by imprisonment for not more than 4 years or makes it a misdemeanor for a person of sufficient ability to refuse or neglect to support his or her family.
In April the Wayne County Sheriffs Department came in with their guns blazing in front of my niece and two nephews that were all under the age of 8yrs old. They were empowered by the new law making it a felony for payers owing more then $5,000.00 in arrearages. I was arrested and held in the county jail on a $100,000 bond until arraingment.
When charged with the crime, I automatically assumed that bacause I am an American, I have rights and that the state has to prove beyond a reasonable doubt that I have committed this crime.
My defense's went up automatically, I knew that I did not commit any felony, and my position was that I am NOT Guilty. The prosecutor is required to arraigne me within 72 hours so I will wait for my day in court.
Finally, after being subjected to the worst county jail system in Michigan. I am tranported to the court building and held in lockup while I await my court appointed attorney whom was so generously appointed to me because of my Indigents.
Court lawyer visits me in lockup, passes a piece of paper through the bars and says to me " you need to sign this document and send it back ", It didnt take but a second for me to realize that it was a Plea Agreement drafted that was a mere admission of guilt to the crime that I was accused of. I handed it back to her unsigned and told her that I am not admitting to any felony charges at this time. Why in the world would I admit to a crime that I did not infact commit? Why would anybody for that matter?
Five times I had to tell her NO before finally the prosecutor comes back to me and states exactly in these words " Look! You want to play f*king hardball? Either you sign the f*king piece of paper or your a* can go back over to the county jail and sit there for six months until your trial date. Whats it going to be?
WOW! That was the toughest choice I have ever had to make in my lifetime. Asking myself this "do you value your freedom" In a splitt second I signed the F*king piece of paper. The threat of jailtime for six months and I suppose the fact that I could not stay Incarcerated while my youngest daughters mom was lying on her death bed.
The agreement I entered into was simple, pay the $15,000.00 over a one year period and the felony will be dismissed. I went back to work literally living at my office for 14 months paying off the felony and also sending my daughters mom a matching $15,000 in Tennessee. My 9 yr olds mom had heart problems and graves disease and could not support herself or my daughter.
In March the felony was dismissed.in May my daughters mom passed away. I drove to Tennessee and brought my daughter back to Michigan. One month after, I found a condo for lease and moved into it with my daughter and got her into a decent school.
In June the sherriff calls me on my house phone. Mr Rolfe, you need to turn yourself in on a new felony warrant.in anger, blown away by another attempt by the same legal agency to commit " Extortion " against me a second time. I told the sheriff, look! If your going to arrest me, bring somebody from the state with you to take my daughter into custody. Oh, and by the way Mr sheriff, the FOC got away with extortion the last time around. If arrested, I will be sure to raise the issue in court. Never heard from him again.
Now here I am, September 10th. The Economy has forced me to lose half my Income which has forced me to have to give up my leased condo. Homeless and searching for a cheaper home for me and my daughter. I have saved up $2,600.00 for a mobile home and was in process of making the purchase. I log into my bank account this morning only to find that FOC has garnished my checking account and left me with nothing again.
I am so sick of these F*king blood suckers. I am the most anti-politcal person that you will ever meet. 15yrs in and out of courts battling for my freedom and being charged with crimes that I did not commit. These people are the real criminals, and they are running My Country into the ground. I need supporters who feel the same way to help me take a stand.
