We went to look at a house with Dale McQuarrie who is an Associate Broker for Help-U-Sell/Beal Realty and we went back to his office in Bangor to make an offer. We are totally unfamiliar with the Buyer's Agreement with an agent and (our bad) trusted him when we were signing papers for the offer and he slipped in the Buyer's Agreement.

We would have never signed a contract to be committed to an agent or anyone for a whole year. We had on the offer contingent on inspection and after we looked it over most of the property was unusable so we backed out of the offer before it was even viewed. It was a bank foreclosure. He called later that week to say that an appointment he had made with us he would have to cancel due to a death in his family. We understood afterall, family comes first. That was on a Friday.

The following week we decided that we weren't finding a house for the price we needed in the areas we were looking so we decided to go further North. We didn't want to at first but decided we would go look around. We found a house we liked and made and offer on it. Two days later Dale McQuarrie emails me with properties to view that were not even in our price range. I told him we had gone North and found a house and thanked him for his services and sympathized with his lost.

He emailed me wanting to know who we signed with. I told him he didn't have to worry it was not one he had shown us or a bank foreclosure. (We thought he only shared commission in houses he had shown us). He called and left a message on our answering machine while we were out saying he didnt' cancel the appointment on the other house we were suppose to see with him and did we want to see it? I didn't return his call.

He emailed me and told me I had a contract with him and I needed to tell him who the agent was that I signed an offer with. I didn't answer him. I found the contract in the offer papers and was appalled! I couldn't believe we had signed these. The date started July 22 and terminated January 22. He also had that in paragraph #4 part d. That we were indebted to him till July 22! I can not believe this.

This contract should be null and void based on the fact that the date is wrong and he never gave us a personaly signed one just typed his name in. He also says he gave us a Residential Property Transacton Booklet which he never did. I called him and asked him to release us from this contract that we never knew we signed. He insisted he told us about it and after arguing a few minutes said he would release us from it. Then he asked who we made the offer with. I told him when he gave us a release I would tell him.

Now this week he must have called all the agents in that area to find out who we went to. It is 126 miles from where we live! He is demanding his 2%. I hope the house falls through. I want people to beware of signing papers you haven't read. I wouldn't have begrudged him a single cent if I had known about the contract and in fact signed it knowingly. But because he is so sneak I want to make sure he doesn't get a cent and if he does it will mean the agent that showed me the house will only get 1/2% while he gets 2% because it was listed by an agency other than the one we made an offer with.

Please, please people BEWARE OF WHAT YOU ARE SIGNING! I should have known better but I trusted this guy. He seemed like a nice grandfatherly type. The worse kind. Do not go to Beal Realty in Bangor, Maine to do your business.
