I got robbed by this company

In June I went to gooptic.com's web site looking for a pair a prescription glasses with clip ons. They are called "Magic clip". I use those glasses for driving.

Their web site indicated that they had them for sale. The price was reasonable and since I needed them fast I paid for the 2 day delivery.

It never indicated that they did not have them in stock and that I could have waited for eternity before they would notify me that they could not get them.

After a week or so I could not see my order in their web site so I called them to inquire about the status of my order. The representative put me on hold for a long time and after a while I was told that it was in process and that I should wait for it to be completed. After that my order status showed as in process. I was never told that they did not have the glasses available and they were in the process of obtaining from the manufacturer.

Two more weeks went by and then I called again to inquire about the status of my order. I was then told that they did not have the glasses in stock and that they were being ordered and that they had no estimated time as to when the glasses were going to arrive at their office. After waiting for more than three weeks and with the uncertainty of when I was going to get my glasses I decided to cancel the order.

After I canceled the order I received an e mail from that company to tell me that since I had cancelled the order I was going to be charged a cancellation fee and was referred to their cancelation policy. This cancelation policy reads:

After an order has successfully been placed with our company, cancellation of an item (or items) in your order may result in a cancellation fee, which is 10% of the cancelled items price. Shipping fee's will be excluded in this fee and cancellation of back-ordered Items will not be subject to cancellation fee's.

This cancelation policy is ambiguous at best. How long does a customer have to wait for this vendor to decide that they can not produce a good that was purchased by a customer?

I tried to tell them that I was in my right to cancel the order because they failed to perform within a reasonable amount of time.

Within a day of my cancellation I received an e mail telling me that they had to charge me because they had the glasses and they had to destroy them. I do not know if they were making it up to substantiate the charge or what. But I needed the glasses and if they would have let me know before they destroyed them I would have purchased them.

In fact the representative told me after several e mails that they could get new glasses within 5 days. I told them that if they had them or get them in five days I would buy them, but then I was told that I was going to be charged a minimum amount for canceling the first time. This was unacceptable to me, by this time it was clear to me that their intention was to over charge me and play games.

I believe that I was robbed $58.29 by this disreputable company and if I can help someone else to not get ripped off by go optic.com then this complain will be worth it.
