Offered Exotic birds (finches) for sale, requested advance payment, failed to ship, no longer responds

On May 16 Bain offered finches for sale through a Yahoo group. I immediately emailed with a request for more info and I made an offer, which he accepted.
He was to ship the birds on June 4 but began a series of excuses regarding his health, his girlfriend's health, the weather (too hot for shipping), and then when a series of his shenanigans appeared in the yahoo group, he stopped answering his phone and emails.
