Attorney Kenneth Gaugh was hired by my Mother to help her in a mortgage fraud case. The mortgage fraud in question was perpetrated by a family member and Attorney Gaugh knew this going in. However, this attorney displayed the most outrageous behavior and lack of knowledge and professionalism I have ever experienced.
First, my Mother is almost 80 years old and my sister stole the title to her home and made a series of fraudulent loans against her property. So when the property went to foreclosure my Mom needed help. Her property went to Trustee Sale and was purchased by US Bank and they have enlisted the help of the Law Office of Garrett-Tully in Pasadena to put my mom out. My mother is horrified. She has no idea what she will do.
Now, everyone involved with this matter knows that the loan was a fraudulent, however no one seems to be able to do anything about it, except that US Bank wants to throw an almost 80 year old woman out in the street and Attorney Gaugh took my Mother's money (what little she has) and he did nothing. Nothing. As I later found out he was even going to her house and she was giving him additional money, all without even giving her any receipts. Very Questionable behavior!
At the onset of this matter, Attorney Gaugh was supposed to have filed a Lis Pendens and because this was very important he was paid additional money again to file this paperwork, however HE NEVER DID. I went to his office with my Mother and he showed me some piece of paper that he claimed was a release of the Lis Pendens, but it was clearly a scam that he had just cooked up to appease us. He never filed anything and he never did anything.
He never returned my Mom's phone calls and he never conducted business in a businesslike manner AND... He is a LIAR.
At a certain point in the litigation US Bank's attorneys wanted to do depositions and since Joyce (sister who did the fraud) had at some point put my Mother's home in James Smith's name (one of soooo many names) he had to be deposed as well as Joyce.
Well it seems that when James Smith's deposition was scheduled, Joyce accompanied him and went into the room and sat with him. James Smith was sworn in and the deposition began. Now since only James Smith was sworn at his deposition how was it that Attorney Gaugh allowed Joyce to answer questions directed to James? And at Joyce's deposition, Joyce was the only one sworn in however, James accompanied her as well and answered questions directed to Joyce and Attorney Gaugh allowed this to continue throughout the duration of the deposition. How could he have allowed such prejudicial treatment against his client, my Mother. He did absolutely nothing to help my Mom, he just took her money. Also, contained in Joyce's deposition were an inordinate number of times her and James went off record. When my Mom asked him what was discussed when they were off record Attorney Gaugh just blew her off. He never did tell were what went on off record. She had the right to know.
There have been so many things that he told my Mom he was doing when in fact he never was working for her.
Now, Jennifer Slater with Garrett-Tull Law Office has this document that my Mom is supposed to sign, however like I said my Mom is almost 80 years old and she does not understand fully the contents of this document and we have been trying to contact Attorney Gaugh and he wll not answer and this matter is very urgent as US Bank is going to kick my Mom out of her home in August. As a matter of fact we went to his office on Saturday, May 23 @ 1:00 ish to keep our appointment, but Attorney Gaugh never did show and we have no idea what to do except try to find another attorney. But we have no money.
The document that Jennifer Slater is telling my Mom to sign contains a clause that reads that my Mom is signing this document and she is not under stress or duress. How is that comment made about an 80 year old woman. Of course she is under stress, but Attorney Gaugh did not challenge anything, he just threw my Mom under the bus.
If there is anybody out there looking for an attorney, do not put your trust in Attorney Kenneth Gaugh, because you will be sorry. His performance was contrite and lackadaisical and when you speak to him in person, it is very clear that he does not care, at all. He just takes as much money as he can get from you and lets the chips fall where they may.
