I made a mistake in entering it in my computer calendar. The hearing was scheduled 09/30/09. I mistakenly entered it in my computer calendar for 10/30/09 the date of the deposition". According to Schmier, he was scheduled to attend hearing "in court" (Southfield, Michigan) and a deposition at his office (Birmingham, Michigan) same day 10/30/09. Oh! Oh My God!!! Laugh. There is proof that correspondence announcing hearing date was forwarded to his office. He Schmier admitted he did not attending hearing (09/30/09) ONLY because there is proof of evidence. Judge William J. Richards of the Michigan 46th District Court in his 09/30/09 bench notis states "not present". The 09/30/09 court transcript notates the same "not present". He Schmier admits inept ONLY because there is proof of evidence. Nine months after accepting legal representation and a $1700.00 retainer, he said "this case is hard" and withdrew as counsel.
