After releasing the case files and petitioning the court to withdraw as counsel, much was discovered about this attorney, James G. Schmier. He is unskilled and did not know what he was doing. Actually, he didnt know what to do. Ouch! Stay Away!!! Attorney James G. Schmier. He is inconsistent and conflicting. He, additionally could not account for fees used/unused. First he said only $300.00 or $400.00 of the retainer amount was used. Then he said all, the entire retainer amount was used but he released an accounting statement showing only $1440.00 of the retainer amount was used. He said three different things. All were inconsistent and conflicting. Wait! Wait! There is more. He (Schmier) submitted to the Michigan Attorney Grievance Commision a Bogus Retainer Fee Agreement. According to Schmier, he sent... (2) copies of a retainer fee agreement and a stamped return envelope. Conversation concerning a retainer fee agreement NEVER surfaced. The client NEVER received (2) copies of a retainer fee agreement and or a stamped return envelope. He (Schmier) begun litigation WITHOUT client signing a retainer fee agreement. Laugh. In documentation submitted to the Michigan Attorney Grievance Commission (File No. 0589-11), he (Schmier) admits inept. I admit I did fail to attend hearing. I made a mistake in entering it in my computer calendar. The hearing was scheduled 09/30/09, I mistakenly entered it in my computer calendar for 10/30/09 the date of the deposition. According to him (Schmier) he was scheduled to attend hearing in court and attend a deposition in his office same day 10/30/09. He admitted he received notice of hearing ONLY because there is proof of evidence. He released the case files accompanying documentation proving him inept. Laugh, Go ahead and laugh. Laugh, laugh, laugh. He (Schmier) admitted he did not attend hearing ONLY because there is proof of evidence - the 09/30/09 court transcript. His accounting statement says client was late for deposition. The attorney was not late for hearing on 09/30/09, he simply did not appear. Oh! Oh My God!!! The 09/30/09 court transcript proves he is inept.
