If you live in New York and have been a victim of Aurora Loan Servicing Company or their parent company Lehman Brothers Bank you can file a complaint with the New York State Attorney General. There website is www.oag. State. Ny.Us. You can go to their website and under "Contact Us" there is a complaint form which must be printed out and faxed in to them. They need two or more complaints to act. I filed a complaint. Is there at least one more New York victim out there?
Aurora sued to foreclose when Lehman Brothers Bank was actually the holder of the mortgage. I had fallen was late on just 2 mortgage payments and when I sent them to Aurora they refused to take them and then sued me for foreclosure. Each month I sent my mortgage payments in and each month they sent it back. There are at least two reported cases which were dismissed because they are not allowed to do this (Aurora Loan Services v. Sattar, 17 Misc. 3d 1109 (N.Y. Sup. 2007); and Aurora Loan Services v. Grant, 17 Misc. 3d 1102 (A), 851 N.Y.S. 2d 56 (N.Y. Sup. 2007). Also, New York State Governor Patterson recently signed the Subprime Lending Reform Bill (S. 8143-a/a. 10817-A) into law, explicitly making this practice unlawful in most cases pursuant to Section 1302 of New York's Real Property Actions and Proceedings Law and potentially criminal pursuant to Section 187 of New York's Penal Code.
The law empowers the New York State Attorney General to enforce it. Other states may have similar law.
In my case, the court personnel sent our file to the wrong courtroom and Aurora's attorneys the New Jersey law firm of Tompkins, McGuire, Wachenfeld & Barry took a default against me even though they knew that I was present in the correct courtroom. The judge acknowledged the error but still refused to open the default. I have been fighting to reverse the judge for the past year but I suffered a heart attack in the process and they are about to get away with using the courts to steal my home.
You can also report them to the United States Office of Thrift Supervision which is the federal agency responsible for regulating them.
Also, if you call the only way to get through to a person is to absolutely not press any of the phone prompts. I confirmed it. If you press any of them it takes you to an endless loop of messages that will eventually disconnect you. You can not press zero to get to an operator. The only way to get through to an operator is to not press any prompts and then it will eventually connect you.
