Both companies want to get money from the costumer who didn't get anything from them

I found Victory Martial Arts Advertisement through a local Kids directory magazine. I called the number and spoke with Mr. Fribourg and tried to inquire about Martial Arts school. He said to have an appointment to come and to show us what they have.

The appointment day was Feb. 3. Mr. Fribourg took us to a small room where he showed us some moves and to let my child follow them. I told him that he was already a red belt from a previous school he went to but he wants to continue and get his black belt. He said he has 2 programs; Masters club and Leadership program. He showed us the pricing and said that the 30 day FreeTrial Membership that was advertised will cost a $300.00 membership fee once the 30 days is done when I enrol later. He said the best way is to enrol now so he will take the $300.00 membership fee and to pay the tuition of $150.00 per month instead. He said that my son will get his black belt around the end of this year. The contract was signed and I was asked to order for the martial arts gear. The total amount of $599.91 with the 1st month of tuition. (Feb. 2009).

I went home and informed my husband about it but he was not satisfied of the program they offered. I called Mr. Fribourg and told him about my concerns and said he wants to speak to my husband. I went back to him on Feb. 6 and told him personally that this is not working with us. He gave me another contract to sign, a 1 year contract instead of the 3 years that was previously signed.

My husband spoke with Mr. Fribourg over the phone on Feb. 7. Mr. Fribourg agreed that this is not the kind of program my husband wanted for our son. He said that it was ok and I went to Victory Martial Arts on that day to return the unused uniform and still on its original package. I asked him if there is any paper work to do to complete the return but he said he will take care of everything for me.

I waited for about 7 bussiness day to get my money back to the credit card account but nothing happened. So I called him again on the 3rd week of Feb. 2009 and spoke with Mr. Fribourg asking him of what he promised to do about the returns. He said that his instructor Mr. Elder will call us and to talk to my husband.

Mr. Elder called us on Feb. 26 and claimed that he is the Director of Victory Martial Arts. He said that we have to go on with the contract but I told him that Mr. Fribourg promised to return everything to us. I asked him are we forced to go on with it eventhough my son did not start any class from them? The line was cut off and I tried to call him back but unable to get through.

I went to Mr. Fribourg on March 2 to try to resolve and put and end to all this. He said he can only try to resubmit some papers about the cancellation and to call ASF international that was in the contract. I later learn that this is the company that handled their billing and contracts.

I called ASF International and told them that I'm cancelling the class from Victory Martial Arts. The representative told me that the tuition is due on March 5. I told them that I have pending issues with the Victory martial Arts and trying to resolve with it. I also told the rep. That the credit card has been closed due to a previous unauthorize activity. The rep told me if the billing will be switch to manual mode of payment I will be charge additional $10.00 a total of $160.00 per month, which was not disclosed to me before the contract was signed. Few days after I received a cancellation form from ASF International. The back of the form has a notice to the buyer that says: We provide a credit line to this facility.in return, this facility has assigned all rights to future payments due under all Retail sales contracts to us. Therefore, all authority to cancel, alter or modify your Retail sales Contract rests solely to us. The facility has no authority to cancel your contract, alter the total amount due or modify the payment schedule in any way whatsoever. This above notice was not written in the contract that was signed from Victory Martial arts.

I am claiming for my rights as a consumer and to be heard from other consumers to put an end to this unfair, one sided business practices. I want my money back and to stop them from continously charging me a $160.00 per month without getting anything from them.in addition to this I never received any martial Arts gear from Mr. Fribourg and the $599.91 is still with them.
