To whom it may concern,
I am a widow lives on a very small pension. I try to take care of my health as much as possible. I am slightly overveight anf I have been looking for a solution to shed some pounds and live as much of a healthy lifestyle as my small pension allows.
I have seen the advertisement of NU U Medspa on Aug. 16.2008 in which it was promised that I would lose my extra pounds if I participated in their "revolutionary" program. So and I decided to give them a call and set an appointment to listen to their presentation and allow myself some time to think if I wanted to participate.
During and after the presentation I was a target of constant high pressure sales talk in which I was told that their product and service is the latest and greatest and how much it helped other people and I should try it. I informed them about FIG (other Company who has a same treatment without succes) They (NU U) respond was: "Our treatment is 100%, even they have costumer from FIG and here they got satisfaction."
I informed them about my financial situation and told the manager, Victoria Dyck, that I was not ready for this and need more time to make a sound decision as participating in the program would involve some serious financial commitment from my part and I am a very responsible person. I asked them what would happen if the program did not work for me. They told me as their program is not refundable, so I became even more hesitant to jump into this program. However, I was still pressured into making a decision on the spot as I was told many times over that the program works for every people. Victoria Dyck had been very joyful because I am hungarian, and she told me her grandmother is hungarian, and very happy to help me. Promised me everything!
Part of the sales pitch was that I was promised 12 months financing for 0% interest rate. After carefully examining the numbers I informed them again that I live off of a small pension and I would not be able to make the monthly payments. So Victoria told me that she would ask for an 18 months financing plan to to make my monthly payments as low as possible. She assured me that the treatments would work for me because they give me enough time to work out the right personalized treatment plan just for me, because I am hungarian too. Based on these condition I finally decided to give it a try.
My decision was based under the assumption that I would get the 18 months financing plan and I informed Victoria that I would have to retract my signature if I was unable obtain that financing. She agreed, but pushed into signing up for a MedChoice credit card, and promised me she will hold it back MedChoice, until I would have visible result after 4-5 treatments, just let start it. I trusted her.
A few days later the treatments started. I was not told to change anything in my lifestyle as they told me that my weight loss would purely be dependent on their treatments. The treatments was only for my belly. Therefore I have not changed my lifestyle, but religiously participated in their treatment plan.
However, after many treatments I noticed that instead of losing weight I was picking up more. I complained about this fact so thay ordered a blood test for my hormones. The blood test showed that I have low progesterone level and this keeps the treatment from being succesful. That is their opinion!!! They gave me a drug 3 weeks dose, to increase my progesterone level and I was taking that medication for 3 weeks, but still no avail.
In the meantime I received my first bill from their finance company called MedChoice. I was surprised to find out that they approved my loan under different conditions that I was told by Victoria on the day of signing of 0% APR. MedChoice gave me only 3 months 0% financing!!! So I called Victoria and asked her what was going on. She promised that she would look into the issue and talk to MedChoice.
However, she did never return my call so I called their office again to find out that Victoria was no longer there as she moved to a different office. So I talked with a different manager who also promised that he would look into my problem. He did return my call informing me that my request for 18 months of free financing was declined by MedChoice.
Before I received MedChoice bill, I talked to their doctor again and informed her the drug she gave me for my progesterone is not helping, but in fact, it made me pick up an additional 10 pounds. So I asked Dr. Burn to stop the treatment and cancel the contract and gave me my money back and void the contract and give a written statement that no longer owe them anything. I had been aware of Victoria holding back MedChoice until we would not see start any result. She asked me for a private appointment where I met Mr. Dan Lumello and Dr. Burn each trying to convince me to stay with the program. They said the treatment did not have enough time to work yet and I should give more time so they could run additional tests and figure out a personalized treatment plan for me. I told them that I did not want to participate as I did not consider myself as a test animal in a laboratory. I knew it was a scam at this point.
Shortly after this appointment Mr. Rawlins Appilado (he introduced himself as the General Manager), called my house. I put him on speaker phone so my guest who happened to stay in my house on that day could hear the conversation and support me as a witness. Mr. Appilado promised that he would try to negotiate a better deal on my behalf with MedChoice and would give me a call back. I asked him "Why I have to pay for something is not working, mainly destroyed me with extra 10 pounds?" I explained to him that as of December 22 the 3 months with 0 % financing would expire and I would have to start paying 10.65 % APR. I told him that my pension only about $980.- a month and even a slight increase in the monthly payments would put my budget out of balance. I also explained to him that I was unable pay this kind of interest on the whole $2.400.- that was charged as I would end up paying out a lot more than this original amount for the years to come for some treatment that never even worked for me in the first place. So I said that the company should just simply give all the money back that was paid to them so far and void the contract and state in writing that I owe them nothing and we would go on our merry ways.
I told him that I believed that their advertising and sales team was misleading and I felt that this whole situation already gave me a lot of emotional stress besides the financial difficulty. After this Mr. Appilado never returned my call even though I repeatedly called his office. Eventually I managed to talk with Victoria again who expressed her true apologies, but informed me that she was unable to help me. But she was able to convinced me!!!
After I went through all this I decided to check the Internet for feedback on this company from other people. I shoul do that before jump in this! I was so naive. I found many complaints. Here I quote one of them:
" There is no system in place to handle and resolve patients who need more aggressive treatments due to unsuccessful treatments, or a combination of all of these things as well as a managers who are enjoying taking people's money and offering the services with no result while giving them no refunds or options whatsoever. IT IS FRAUD!"
Here is another one:
"It would be one things is felt like they tried everything they could to hel me and I just were'nt having result, only worked for opposite, but the fact is despite all of my complaints, they have not tried to help me at all. There is no reason for them to deny attempting to make things right with me, unless they know already that already all they have to offer is FRAUD!!!"
In view of the above, I would highly appreciate if you could start investigating the business practices of this company further. (They have no any license in Arizona.) I also would like my contract voided and my money back. I was duped into signing their contract. I never liked their no refund policy that that I unwillingly signed under the condition that I would get 18 months of free financing.
Looks like this company takes unsuspecting people's hard earned money and they do not care about whether a patient actually loses or gains weight as they are getting a guaranteed income with their no refund policy that they have people sign. Obviously, this policy is a protection against the refund claims of many unsatisfied people who did not benefit from their treatment. Other businesses do not have this no refund policy and I am not sure why the State of Arizona allows this company to operate in such a way.
In view of the above, I would highly appreciate if you
-contacted thye company and ask them to refund my money or run this story to inform your viewers about their fraudulent practices.
-contacted the State of Arizona and ask them to put legislation in place that would forbid companies applying a no refund policy.
I am also contacting the Better Business Bureau to bring their attention to unfair and misleading practices of this company.
I am in the process of contracting some class action litigation attorneys and some other victims to bring a class action suit against this company.
I appreciate your time and will forward all the documents that support my statements upon your request. Unfortunatelly they refused to give me copies, but I still trying.
(Ps.: Finally $2.200.- transfered to another creditcard, where I have 0% financing for 8 months, which is still not enough time to pay out this amount. I had to do taht to avoid MedChoice high interest rate.)
