I am a Single Mother of 2, and a U.S. Citizen born and raised. Who learned that if someone can make a 'False Report' to 911 dispatch and if you are home alone with a Toddler (no Adult witness, an Atty. On retainer or the financial ability to retain private counsel at a moments notice) YOU ARE SCREWED!
On March 28 I called Peak Vista Women's Health Clinic (PVWHC) for a Refill on my pain Medication. I had been on Vicodin for 25 days and was on their waiting list for a hysterectomy sometime in July.
Instead a Triage Nurse there made a 'False Report' to 911 stating that I had threatened to harm my 3yr. Old daughter if I did not receive a refill on my Vicodin. She also stated I had received over #110 tabs in 3 weeks, so I was refused.
ALL LIES! I do not have a 3yr. Old daughter, had not received that amount of medication and that was not the reason I encountered problems that afternoon she was.
My BIG MISTAKE was needing Medical Assistance from that Clinic on a Friday afternoon.
Colorado Springs Police (CSPD) Initially went to an address in my neighborhood where my truck had broken down 6 months earlier (but was not given by PVWHC and has never been / or listed as My address) and shared this incorrect information with the people there.
When they finally arrived at my home I looked out my window and saw 2 CSPD Officers on my steps along with My Boyfriend. I opened the door, My Boyfriend walked through and the 2 Officers grabbed the screen and walked into our home without a Warrant, Court Order or Invitation.
Once in my living room they announced they were there for a Welfare Check. We told them there must be a mistake when they announced they were there because of a call from the Triage Nurse at PVWHC.
Both CSPD Officers were presented with evidence to dispute most of her claims but they chose to ignore it.
There is no recording of the alleged conversation and no Report was written by the Officers. The only records they have are the Call For Service Screen and "911" dispatch recording.
Those 2 Officers had me removed from my home (after relay untrue information to Paramedics outside my home: That I had overdosed by #10 tabs of Vicodin, which I never had.) by Ambulance and transported to Memorial Hospital ER.
At Memorial Hospital ER I was seen by a Social Worker who hid information from us and failed to investigate the claim or contact either of my Treating Providers.instead she lied to us about what was about to happen to me and who was making the decision.
She alone made the decision to send me on a 72-Hour hold at Cedar Springs Hospital, she said the attending was sending me for a 12-Hour Evalution.
She lied and told us she spoke with the Person who made this report before she left for the day. That person was a Licensed Medical Professional with the State of Colorado and I was home alone with a 3yr. Old so what she say matters and what I said did not.
I learned later while gathering paperwork and information that. NO ONE spoke to the person who claimed I made this statement, she supposedly wrote an 'Incident Report' and went home to enjoy her weekend.
All the information shared among these Professionals & Entities was second-hand. NO ONE outside has a copy of the alleged 'Incident Report' and PVCHC refuses to grant access to it.
Her report is fabricated and I am able to provide information to dispute their alleged account.
The Attending Physician involved has been involved in a similar incident at the same Hospital and failed to do his job then as well, that time with fatal consequences. As a matter of fact, they settled a $325,000 lawsuit 2 weeks before this happened to me.
There would not be these types of 'Incidents' if the Memorial Hospital and its Employees did the jobs they were trained, paid and expected to do.
At Cedar Springs Hospital I was admitted, assigned a room, made to strip down for a Nude Full-Body Inspection. For the Inspection I was taken into the bathroom in the room I was assigned (to share with a Schitzophrenic Patient) and told by an Employee (with questionable eyesight, qualification and authority) to remove all my clothes, lift both my breasts, squat several times and to bend over and touch my feet in front of her.
The following morning I was seen by the Evaluating Doctor who noted in my file 'Unfounded Report', 'Hospitalization Wasn't Necessary' that I 'Will Not' benefit from admission to their hospital program, prognosis 'Good'.
In spite of this a Social Worker stated that she would not risk her license and agree to my release regardless of what the Doctor thinks. That I obviously made the threat to that Medical Assistant or I would not be there. And with all the crying I was doing maybe I could use a break from my family.
She then told me that the only way to stop DHS from taking my children and placing them with other families was to stay for the entire 72-Hours. That i needed to decide what was more important: My Children or going home. Tell her and she would write that in my chart for the Courts.
On the day of release, March 31 I was taunted with Release by the Charge Nurse throughout the day. I was repeatedly told to stand by the door with my belongings to leave then later told I could not. The Charge Nurse made up various untrue excuses for the refusal to allow me to leave.
They even had another Doctor come talk to me. He stated the Evaluating Doctor thought I should be released but that he had been informed this was not DHS's first involvement with me & my children and he thought we should discuss my feelings on the upcoming court date to terminate my Parental Rights. I calmly told him he was mistaken there was no previous involvement by DHS and that there was no action being taken to terminate my Parental Rights. He like all the other Medical Professionals involved stated he would contact my Treating Healthcare Providers to clear this up, but he did not bother either.
April 1 El Paso County DHS 'Vacated' the Temporary Protective Order, Court and said they were closing the case as 'Unfounded'.
No one at PVCHC seemed to be aware of what this Medical Assistant & Triage Nurse had done to me on Friday.
I was in complete compliance with my Treatment Plan. The Treating Doctor I was requesting a refill from doubled my access to my Vicodin by prescribing 2 week supplies at a time. But, only after he circumvented PVWHC procedure and had me make my Surgery Co-Pay for a Hysterctomy they could provide until possibly sometime in July. I was oh their waiting list.
6 weeks after this PVCHC started sending me checks with no explaination in spite of wriitten requests. I was told that they were now refunding the $450.00 (plus other Co-Pays) that they so desperately needed before providing the only relief they had available to me for months.
I have been to numerous Attorney who have all said I have a good case and more evidence than they normally see from Clients but they either don't handle my type of case or want thousands of dollars I DO NOT HAVE upfront.
I have very detailed information and a stack of documents to back up my Claims. I can provide the Colorado Revised Statutes that have been violated.
I have met the Notice requirements under the Colorado Governmental Immunity Act.
You hear about things like this in other Countries or see it in movies, until it happened to me in the United States (Colorado) I thought I was protected by the Constitution and Federal law.
When did it become legal to remove someone from their home based on False second-hand information, without any paerwork or supporting evidence and lock them in a Psychiatric Hospital with truly dangerous people?
Why are only the low-income private sector held accountable for their actions, both civil and criminal?
I hope this serves as a possible warning to others and that someone who is in a position to offer assistance sees this report.
