LVNV Funding/Weinstock & Friedman said they served papers on me at an address where I was not living and had not lived for 6 months. I never received any papers, a telephone call, or anything. I called the Court and they said they would reset a new trial date. I still did not receive papers at my home, service or of a new trial date. When I called Mr. Evert of Weinstock & Friedman, he told me it was very lawful for them to serve papers at a home where I didn't live. How is that possible? He said that "that is not our problem."
I do not know who LVNV Funding is. When I called Mr. Evert of Weinstock & Friedman, as soon as he picked up the phone, immediately he went into the phone call saying, "I understand you want to make payment arrangements." I told Mr. Evert I didn't know who he was and would get back to him. The next day I called Mr. Evert and he then said that during our last discussion I agreed to pay him a percentage and then $500 a month. This is not true either! He also said that prior to filing papers he talked to me. Again, I HAVE NEVER HEARD FROM HIM EVER.
I asked Mr. Evert to please send me whatever paperwork he had with my signature, a ledger and account balance because I did not know what he has and what I would be agreeing to, etc. Mr. Evert began to yell at me on the phone and said he did not need to produce anything. Then he called my phone back and left another message yelling. Next thing I know I have a garnishment.
How can someone file a suit, not serve anyone in connection to it, not provide any back up, get a judgment, and a garnishment? How is this possible? Is this our legal system's way?
I had this job for 6.5 years, a single mother of an child who has sever ADHD, and now have been fired from my job (HR in a law firm) due to this. My last day is 12/31/08. I need to take recourse immediately. I need answers.
