Wrong order received - company said they 'upgraded'

We ordered two atv-88's from ATVDisounter on November 06. After three weeks, we called this company to see what the status was on the order. Doug, one of the many "stay at home salesman" for this company, told us what the tracking number was. We found the shipping history finally on the shipping companies website and they said it should arrive in three days. They were right in this one circumstance.

I went to the trucking falcility this company utilized once informed the shipment had arrived and picked up the two atvs. It took three grown men. These atvs, with apckaging, weigh approximately 300 lbs. My dually barely held the two 110cc atvs.

Once at home, we unloaded these two atvs and began putting one of the units together. It took apporximately two and a half hours to assemble this unit. The guys and I that assembled this one unit are very mechanically inclined as well as past fourwheeler racing guys (GNCC Circuit in Georgia) that are very comfortable around atvs. This unit was not 95% assembled as the sales lady (Trisha Barling) stated at the time of order. So, one is assembled, we are sitting around the shop looking at our 'masterpiece' and I noticed the worst, this is not the atv we ordered. I looked at the other box - it is wrong also.

I notified Trisha Barling and told her of the situation by email because apparently she does not do the good old fashioned phone thing AT ALL. She replied saying she would check into it with warehouse and get back with me as soon as possible. The two atvs we ordered are called atv-88 on atvdisscounter.com. I looked at the boxes these units were shipped in and found some very good information These two units were shipped out of Ontario, CA from a company called KMD Powersports. I went to there website and found the two atvs we had received. The two we received are considered atv-49r on kmdpowersports.com and the two we had ordered are considered atv-26r on teh same website.

ATVDiscounter.com does not even offer the atvs we received on their website. Several days go by with no response from anyone with atvdiscounter and I was blowing up their phones and emails trying to get this matter resolved quickly so Santa could give these two units by christmas.

Finally, Trisha (one of the great salesman this company has to offer) replied saying to fix all the confusion she would send two helmets for my unpleasant experience. I, quickly, let her know that offer was unacceptable and other options needed to be set forth.

To this day, I have not heard back from her. I spoke with another salesman, Patti Rodriguez, who said she would help as much as she could to rectify this situation also. I sent all info I had including ALL e-mails to her and guess what, never heard from her again. I have since spoke with other salesman, Doug, Steve, Michelle, and Sherri and no one wants anything to do with this situation.

I got on the fabulous internet and found a company in Arkansas that sold these fourwheelers for ATVDiscounter.com and the guy gave me a number to a manager of all of these salesman, you will not get this info. From one of the salesman, by the name of Nathan (214-736-8880). By the way, we received the titles to these units days after receiving the units and not only got the wrong units, but received 2007 models according to the titles. We called Nathan and left a message for him. Several hours later HE ACTUALLY CALLED BACK! I notified him of the situation and wanted to know what options wefe going to be set forth to rectify this situation. He stated that his company has the right to change the order if it deems necessary to make shipment.

I informed him again, of my situation and he started some terms of use clause no one has ever heard of and said we got what we received and that the sale was final, his company did not do exchanges or refunds. He did offer to give me an extended warranty on these units or send those two cheap helmets to us for our unpleasant experience. I informed him I would be contacting my charge card company to get the transaction backordered and he needed to schedule a time convenient to me for pickup of these wrong two units. He said there was not anything we could do about the transaction and that the debt would still be there.

Upon getting off the phone with the rep. From atvdiscounter.com I notified my credit card company and told them of the situation. They are more than willing to and happy to take care of this situation for me.

I will update as this is resolved, hopefully!

Please, everyone that reads this, DO NOT buy anything from this outfit called ATVDiscounter.com. All of their salesman work from home and they have no inventory. They ship from other atv suppliers and have horrible customer service. I believe this company is a fraud and hope this report has a huge impact on your decision before having a transaction with this company.
