They contacted me regarding selling my timeshare in Florida in June '08. The message was Cosmo from about the Likie Tiki property I had listed with them. He said call 866-685-4616 at ext. 219. He had said they had a buyer for my property but I could not get him to answer when I called. I wish I had written them off then. On August 7th Kathryn Garten called and said they had been trying to reach me about the sale. It was offering $23,500. This sounded too good to be true. I told her I needed to think about it. She called several times after and left messages on my answering machine, never with the information only a call back number that was the same as Cosmo with a new extension 216. Funny when I called it before the money was exchanged, I got through every time. She called me back and said that they had an immediate and confirmed buyer and all I needed to do was pay the fee and our deal would be started. I called her back and after negotiating with her. We agreed on $1550 for their fee to start the process and complte the sale. If I was unsatisfied with the paperwork when I received it, I could receive a full refund. Well after several days and not hearing or seeing anything I called again and again and was never able to get a hold of "Kathryn". I did manage to speak to her once and she assured me my paperwork was on the way. She said she would "look into it". She called to say the documents went out and I should receive them in 2 days. 2 days went by and nothing so I called. She said she would send them again. I called my credit card company and they said when the paperwork arrived I could begin a dispute if it was not as promised but now they seem to think the paper contract I faxed has loop holes in their favor.
The faxed contact I had signed had "N/A" through just about everything except for the sales price, resort name and my name. Only the sale was specified. I made sure to choose my words wisely when they do their normal "recorded for verification" process that says they didn't give you "the name" of a buy and so they don't get caught for bait and switch. I also made sure to save any phone conversations they left on my machine and also records of all faxes.
The paperwork was mailed Aug 22 and it is just a listing and the company address and almost all other details are different. (the cancel limit is 10 days, they told me so it is already too late). I told them I wasn't interested in a listing. I was paying for the SALE and I wanted the refund. I was told I need to speak to "Jessica" who is a supervisor but have never been able to speak to her. I have left message after message for them and I only get the answering machine. They also will not answer the email. Your money is gone and you get NOTHING if you trust them. DO NOT let them get you too.
