In my house started to have problems the insurance company was notified came out and said yes we had a problem, well our problem was huge.
The house was twisting off its foundation because of structural problems, the house had been inspected 3x by various groups, the va, the bank and insurance company, everything was ok in 1998, and 2003.
The insurance company was suppose to send someone out to get an estimate for repairs, no one came. Then a geological crew came out, found no compaction in and around house. The insurance company then sent a check to repair the floors, 21,000.00, we had an engineer come out and he stated the house could not be repaired, and if we did it would be in excess of 180,000.00.
The check which was coded for malicious damage was then sent to citi bank, for holding. We contacted citi bank and informed them the house was unrepairable, numerous times over the next 3 years.
We hired an attorney to file a claim against tower hill, after 2 years he said he filed a complaint and we recieved a letter to that effect. 6 months later attorney sent a letter denying he ever sent tower hill a letter and then stated he felt we had no case, we were told he had great success with tower hill, little did we know he worked for them previously. So he had great sucess working for the insurance company.
According to the insurance company we were only covered if the house contacted the ground. The damage was hidden and a hole had to be cut through the floor to gain accesses to the underneath.
Our insurance covered the house for everything, we even had insurance to cover the mortage from them and our bank, as well as insurance to live in another location until the home was repaired.
We contacted another attorney and after 10 months we have heard little, we have called and written, and recieved bills for that service but nothing yet.
In 2007 we were notified that the house insurance was cancelled due to the condition of the house. And no other insurance company will pick it up due to the condition of the house.
We have been told if it does go to court it will probably be 3 to 5 years, well i can tell you this the house will not be standing for that length of time. The floors have 2 to 3 inch gaps from the base boards to the fllors, you can see the underneath dirt from some rooms, the interior walls are twisted and the kitchen and bathroom cabinets have pulled away from the walls. The tile floors are all cracked and caving in, the bath tub has a crack across it and leaks water from a 1 inch gap. The floors in the bed rooms have holes in them and in one bed room the bed is falling through the floor and can not be slept in.
The rats are entering the house at night, along with the insects. Our electric bill is over 500.00 per month to heat or cool the house. My husband is disable, and my father is elderly. And i have a child in school.
I work nights and pray to god that my family will be ok, and the house will still be standing in the morning with everyone safe.
The bank finally released the money because i did not pay them for 5 months, i asked them to put it on the payments, so i would have had at least 2 years to possibly bring this to court. That was denied, the payments, are still behind, they are trying to modify the loan. I asked if i could just pay the interest for the 5 months where they had just recieved a lot on the principle. That was denied.
I only owe 116,000.00 on the home, the insurance for the house alone was 195,000.00.
Help me please, i don't want to loose my home, and i don't want to see my family hurt. We have no place else to go.
