Hello

My name is Arielle * and I am contacting you because my landlord failed a code inspection by code enforcement in March and at the same time I discovered my unit is illegal because A. It is a converted basement. And B. He never had a permit to renovate or inspected for code. At that time he received an administrative warning from them to take care of everything in disrepair and I sent him my 4th or 5th request for repair. There is NO heat in the unit, and during the summer that may not matter however I have lived in the unit for 2 years and he was supposed to install heat when I moved in. The oven is broken and I have cockroaches. Well I moved in and basically never saw anyone again even though the owner/landlord lives directly across the street.

He responded first with an admission of guilt and then demanded rent! If it is illegal the lease is null and he cannot accept rent! He stated if I paid the rent he would install the heat and fix my oven. I have been here 2 years without heat, 6 months without an oven a broken, cockroaches, a neighbor upstairs who broke into my house AND removed the 60 day notice when it was posted amongst NUMEROUS other code, health and moral violations. I filed a small claims case for breach of contract against the landlord and owner. The ownership changed in 07 without a word to me about it or whom to contact regarding the issues that I had.

Then received another notice from the new owner who I do not know that said he would forgive all debt if I would just move out. (due to failed inspection). Well I have two children in school locally, I work nearby, am a single parent with a full time job and little money and if I have to move out I want him to pay for it as well as reimburse me for costs I have incurred on the property due to his neglect. I exercised my rights to the letter. Notice, 2nd notice... Etc. MONTHS went by and he STILL to THIS day hasnt repaired nothing and managed to skip the court date for my small claims hearing date by not showing up and refusing the summons. So the court date was reset to the 15th of this month and the other day I receive a request to postpone the 2nd court date because of another case open that could dissolve of my case. I was thinking what is he talking about?

Today I received an unlawful detainer. Mind you I only received the 60 day notice by mail a month ago and it sure wasn't posted on my door but regardless. He is now playing games to evict me because his unit is illegal and he wants my trouble causing butt out of here. That's not fair, what about my small claims case? He owes ME a LOT of money for things I have organized in files behind the cost!

An important fact is the lease agreement attached to the unlawful detainer is a forged and fraudulent document. It isn't the lease he gave me and it isn't my signature AND it isn't anything like the one he gave me when I moved in. REGARDLESS he has a criminal case against him for the illegal unit status, he never ever even called me to offer repair stating "he doesn't like writing" as a response to my requests and his response 6 MONTHS later. It is an illegal joint, the lease is null, he can't collect rent, he owes me about 6500 dollars in utilities that I had to pay as there is only a single meter in a house that is registered as a single dwelling but there is a tenant upstairs on top of house and me and my kids down here in the illegally converted, no heat, no oven, cockroach infested basement. I have such awesome case but I am not financially capable of retaining legal counsel.
