Chase MasterCard does not portect customers from fraudulent and deceptive merchants

We bought a Sleepinergy Bed at the Napa-Solano Home & Garden Show May 18 for the amount of $4,990.00. The bed was delivered the same day we purchased it. The first night owning the bed we noticed it caused us serious pain in our back, hips and shoulders... Beside that, the adjustment broke within the first two hours of owning it. Second day owning bed we flipped mattress over to soft side thinking this will help with the pain. Nope! The pain was even worse. When we unzipped the mattress cover trying too figure out why the bed is so uncomfortable/painful..."We discovered the big scam..." The sleepinergy bed we tested at the home and garden show is not the same bed Sleepinergy delivered to our home. The mattress foam we got in our Sleepinergy bed is (very thin) and does not even have half as much foam as the show demonstration, and under that little bit of mattress foam is a hard box type thing. When laying down on the mattress it doesn't take long before the foam smashes down flat, then we're laying on top of a hard box.

After realizing the scam, I started looking for Sleepinergy and found them at the Sacramento Country Fair the very next weekend. We went to the fair armed with two wittnesses and a camera. We took pictures of Sleepinergy showroom demonstration bed & mattress foam sample... Of course we have photographs of the Sleepinergy bed in our home. When the photographs are compared it absolutely proves Sleepinergy fraudulent/deceptive business practices.

I have talked to (George Klause) owner of Sleepinergy, "told him we want a refund because the bed is very uncomfortable causing us pain... He got very mad and said he doesn't have a retrun policy... To make a long story short, I hang-up the telephone on Mr. Klause too end his obnoxious ranting...

I have e-mailed Geroge Klause a pictures showing and the proving the Sleepinergy scam and demanding a refund. Obviously no refund yet.

George Klause is the same person usacomplaints.com has complaints on regarding Ergo-Pedic. I have accumulated a lot of important information on Geroge Klause and I have some new information. George Klause is not the only Sleepinergy owner.

I have been informed I have three years to pursue fraud charges. However, I am not waiting that long too see Mr. George Klause and all other owners of Sleepinergy be prosecuted. I have filed domplaints with, Attorney General, Better Business Bureau, Napa County District Attorney, Federal Trade Commisdsion, State of California Consumer Affairs, complaint and talked to ABC. Tv. Channes7,7 on your side last week.

(If you're a victim of Sleepinergy, Ergo-Pedic Sleep System, George Klause, Or John Lovett) please file a complaint with the Attorney General... The more complaints filed the better.

I filed a dispute with Chase MasterCard before 24 hours of owning the bed. I'm sorry too say my experience dealing with Chase MasterCard & JP Morgan Chase Bank is disappointing... I sent Chase photographs of Sleepinergy's show-room demonstration bed & demonstration mattress foam sample, Photographs of our bed proving the fraud, sent copies of my witness's statements & copies of the consumer complaints. I also included a letter letting Chase know the state of California Consumer Affairs (Home Furnishings and Thermal Insulation Department) is very familiar and has dealt with Geroge Klause/Ergo-Pedic, and now Sleepinergy has been added to the list of fraudulent & deceptive business scams. I told the duspute supervisors I have filed a complaint and I am now in contact with Consumer Affairs regarding this Sleepinergy/George Klause case.

Three different Chase dispute supervisors told me that Chase does not, and will not include my Sleepinergy photographs, witness statements, consumer complaints or even Sleepinergy George Klause past deceptive/fraud business practices as dispute evidence. I told the dispute supervisors the State of California Consumer protection law allows a consumer to break a sale contract if deception is involved, but the supervisor made it very clear to me, that Chase has their own rules and what matters to Chase, is the sale receipt. I asked this supervisor for a copy of their dispute rules. She told me I'm not allow to have that because it's inside information. "I don't understand how Chase claims they investigate a dispute when they base their dispute decision the sale receipt."

Sleepinergy/George Klause and the other owner (s) knows exactly how Chase MasterCard dispute rules work and he makes sure he words the sale receipt as to get paid. I have been educated about the credit-card Companies being allowed to make their own rules and not having too complay with State Consumer Laws... I feel Chase has again victimized me by allowing Sleepinergy to get away with this scam. I would not be dealing with all this Sleepinergy fraudulent nonsense right now if Chase had done a simple credit card charge-back, but they refused to do that, and here we are.

I have made every good faith effort to prove my dispute case; however, Channel 7 on your side News has asked me to write JP Morgan Chase Bank and ask them to reconsider the dispute denial. I am in the process of doing that.
