Homecomings
Reporting false information on credit report/Dishonest and unethical practices

Thursday

My name is Tarsha and I am a 34 year old african american with a masters degree in Counseling and a national License as a Licensed Professional Counselor. When I finish with Homecomings I'm sure I'll need counseling myself.
I am not sure where to begin. At any rate, I purchased my home in December 04.in February 05 my loan was bought by Homecomings Financial from Kellner Mortgage. I was aware that I had an adjustment loan and was told by my realtor that it would be much easier to refinance than the closing process. After my two years, the mortgage begin to go up every 6 months from $830/month to $1600/month. This was very scary but even though I was nieve I understood it was nothing I could do unless I refinanced.in May I begin working a 2nd fulltime job because I wanted to keep my home and I thought that if I would be able to pay the increasing mortgage, it may be easier to refinance. I attempted to refinance 2x with no luck. Once they started increasing my mortgage there were several illegal and unethical situations that transpired against me by Homecomings.in september of 07 I found out that I had a mild form of Leukemia and I began to contact Homecomings to inform them that by the end of the year I would not be working a 2nd job and I needed assistance. I was told that there was nothing that could be done for me and I did not qualify for a loan modification. I continued to call week after week and by February 08 I was told to download paperwork to document monthly income and a breakdown of my bills. Once this information was recieved I was informed that I did not qualify and was given the number to the govern and was told that they would be able to assist me. When I spoke with them they informed me that I would not qualify for their modification due to not being 30 days past due. Needless to say I had to be 30 days late in order to apply for a loan modification with homecomings or the government. I was late in February of 08 and when I contacted Homecomings for the 18th time I was then able to apply for loan modification. This process was very teadious and draining. From January 08 to March 08 I experienced anxiety, mental anguish and was unable to sleep. I was at the point where I felt as if I could not fight anymore and I told Homecomings that they could come and put foreclosure sign in yard because I could not take it anymore. Ironically after telling them this they stated that they would be able to assist me. After several weeks of waiting for someone to contact me about the status of my loan modification I was then informed that my payment would decrease from $1650/monthly to $1051/monthly but I would be required to make a down payment of 1650 which was the amount that my monthly mortgage was. I was also told that I would not be reported to the credidt bureau because my loan was in the modification process. I was also told that after I made the down payment of $1650 in March to begin making the payment of $1051 in April even if I had not received anything from them. I paid the $1051 in April. On may 6, I received a FEDEX package containing the Loan Modification stating the terms of my Loan Modification which stated that my monthly payments would be $1051 and I would need to make a down payment in May and would not pay again until July. This paperwork had to be notarized and someone came to my home to notarize the paperwork. For some strange reason I was not feeling very good about this being that I was told that my payment of $1650 in March was my down payment. At any rate, I went to a toyota dealership on last Saturday and was informed that I couldnot be approved for a preowned car because Homecomings had that I owed 4,036. I was Livid, shocked and embarrassed. I knew that Homecomings was shady and unethical but it never crossed my mind that they would go behind my back and do this to me. I contacted them on Tuesday of this week. When I asked them why was I told that nothing would be reported on my credit and they in turn had me owing them 4,036, I was told that whoever relayed that information to me was incorrect and until my loan is current it will remain on my credit report. When I asked him for the breakdown of the 4,036 he told me it included being late in February, March and April. I asked him how could I have been late in March when I paid 1650 which was my regular payment for the month in which I was told would be the down payment to qualify (not be approved) for the Loan Modification and in April I made the payment of 1051, which was the amount that was agreed upon after discussing my monthly income.in additon to this, Iw as also told that the late payment for the month of February 08 would be deleted from my credit report due to the loan modification being processed He was unable to give me an answer but took great pride in telling me that the 4,036 will remain on my credit until my account is current and then changed his story to state that it will be on my credit for 12 to 24 months. At this point I pretty much lost it. I felt like I was going crazy. I live in texas alone and all of my family resides in Louisiana. I donot want to move back home because ST. Lukes Hospital is one of the best Hospitals in the World to get treatment for any type of cancer. I have not sent in my Notarized paperwork for the terms of the Loan Modification. I really don't know what to do and I am scared out of my mind. I was also sent a letter on 5/5/08 while my loan modification was being processed which stated that I owed 4,036 due to nonpayment and if this money was not received 30 days from the date of the letter, foreclosure process will begin. This was also a shock as I was told to disregard any paperwork that I received while my loan modification was being processed.intially I was not worried about this. Now I am sacred out of my mind because they have placed this amount on my credit report and sent me this letter. If they have gone to this extreme, it's no telling what they will do next. I have read the horror stories and I have experienced them as well. This is not the first time that Homecomings has done something ilegal or unethical to me. My back is against the wll and I really need some assistance. I am begging you. At this point I don't know what to do. I am planning to put my home on the market despite how bad the market is at this time. I do not want to foreclose on my home. I have worked 2 full time jobs for a year and I am now working a full time job and a part time job to make sure that I can make my payments.

Thank you for your time
