Purchased a vehicle that broke down, promised to fix, 3 months later still no vehicle but repossessed it after no taking their harrassment!

Detailed list of Events of the Dealings with City Auto Wholesale

12/19/07 Jason and Nicole went into to City Auto Wholesale to try and purchase a vehicle. Spoke with Chuck, and after running numbers they only qualified for 2 vehicles on their lot. The Dodge Stratus was a severely beaten up used car. He then showed them the 1999 Mercury Villager. At first it didn't even start. He stated the battery was dead because it had been sitting a while. They didn't want the vehicle at first due to the condition. Chuck said he would jump the van so we can take a better look at it. Jason, Nicole, and their kids walked back up to the sales office trailer.

When Chuck pulled up the van he stated to them that the brakes were too bad on it to take it for a test drive. Jason and Nicole were very skeptical on this deal. He then proceeded to make promises to them on the condition of the van. He would have the brakes fixed, a stereo put in it, and an inspection of the vehicle as to the condition of it. Jason and Nicole agreed that if he upheld his end of the deal and the car was in proper condition they would purchase the vehicle. He then asked for Identification, Pay stubs, and the titles of our vehicles.

Nicole then told him that they had lost 1 title, which was for the 1997 Ford Taurus, but they had the title for the 1997 Geo Metro. Chuck stated that it wouldn't be a problem, and it would just cost them roughly $250 for a lost title fee which would be written into the loan.

Nicole and Jason were told that on January 7th they were to submit to them a down payment of $500 to show the bank that they had something to put down along with their 2 vehicles, and they were looking at payments of $300. They then signed some type of financial write up, was given the keys to a Grand Prix as a loaner until we got our van back. As they were given no paperwork in hand, Jason asked Chuck when we would be getting all copies for their records, and he said, Don't worry we'll mail all copies to you and you'd be getting a call from the back in a couple days to go over the payments and miscellaneous stuff. He then handed Nicole a yellow copy of a paper that stated they were using a loaner from City Auto Wholesale, in case they were pulled over.

12/22/07 Chuck called Jason and stated that the vehicle was ready for pick up. He was asked if everything had been done as they agreed 3 days prior. He stated everything was taken care of, and everything in the car looked great. Nicole drove to the dealership to return the loaner vehicle and pick up the 1999 Mercury Villager. When Nicole picked up the vehicle Chuck stated that he needed to pull it up. When he did so, he parked it front of the employee office and left running. Nicole looked in the vehicle and noticed that a stereo was not put in the vehicle. When she asked Chuck about that he stated that they didn't have an extra one around, so they would have to make arrangements for one to be installed at a later date.

She then asked him if the inspection on the vehicle had actually been done, and he said yeah don't worry about its all taken care of. Nicole then drove the vehicle home. During the ride home the van started making a whining sound. Nicole called home and stated what she was told by Chuck to Jason, but it was obvious that an inspection was not done as was stated.

When Nicole came home the vehicle was parked in their space and left there for the remainder of the day. When Jason went out later that evening to go to work the car started, but when he backed up the car died. He thought it was out of gas, so he walked to the gas station. Filled a 5 gallon can of gas, and put it in the van. He then asked a neighbor to try and jump him with battery cables, as it still wouldn't start.

After charging for quite some time Jason tried to start the van. It still wouldn't turn over. Since it was very late at night he decided to call in to work as he couldn't make it in, and call the dealership in the morning.

12/23/07 Jason calls City Auto Wholesale to ask why his vehicle is not working if it had the inspection on the vehicle done. Mike could only give an answer of, Well the battery must be completely dead, just replace it and bring the receipt in and we will refund you for the cost. As it was Sunday, we had no vehicle couldn't get to any banks and had to wait till Monday, Christmas Eve.

12/24/07 Nicole catches a bus to work at 5:15 A.M. Goes to work, gets a ride from a co-worker to get a new battery and then a ride back home. 11:05 A.M. Jason installs the new battery, and tries to start the van. The van still doesn't turn over. The only thing Jason could think of is that the van must have been bone dry in gas and what he had put in wasn't enough. So he then walked back to the gas station and got more gas.

After putting another 5 gallons into the tank the van would still not turn over. Around noon on Christmas Eve Jason calls City Auto Wholesale to speak with a manager. After given the run around by several sales guys he was given to Tony. Tony then told Jason there was nothing he could do, he couldn't honor what Chuck had told us, and we were now stuck with this van that doesn't work. Jason then told him that Oregon does uphold a lemon law, and Chuck stated an inspection would be done and when the vehicle had been picked up, Nicole was told everything was fine, but it was obvious they had been lied to. Tony then said he would have the van towed to a shop to have it looked at.

A tow truck driver came around 2:30 P.M. And took Nicole with the van to City Auto Wholesale to get reimbursed for the battery and pick up another loaner vehicle. Nicole asked about what would happen with the van, and was told to give them a call in a few days.

12/27/07 Jason calls City Auto Wholesale to get the status on the van and was told it was still being looked at and they couldn't say what was wrong with it or how long it would be, but to just call back in about a week.

12/29/07 Nicole and Jason received a call from Metro Auto Wholesale. They went down to see if they can get into something better. They explained the situation they were in and were told that they, as they were not financed yet they could still go through them. Nicole and Jason had already received a denial letter from Reliable Auto Credit. Since Nicole and Jason had a loaner vehicle from City Auto Wholesale, Metro Auto Wholesale agreed that they would have the car towed to City Auto Wholesale and pick up the vehicles that were used for trade-in. Nicole and Jason signed actual Loan papers and were given copies. All parties were aware that financing could still fall through.

Metro informed us that they needed to call City Auto Wholesale to notify them that since the vehicle is not in working condition, a down payment has not been made, and that Metro Auto would be picking up the trade-ins, and they would not be going through City Auto Wholesale for a purchase.

When Jason arrived at home he called City Auto Wholesale. He then told Tony that they did not want to go through them, especially since they lied about the condition of the vehicle which is now in a shop for who knew how long, and that they had already been sent denial letters, and they were going to go through Metro Auto Wholesale to try and finance a vehicle that ran. He then told Tony that their vehicle is at Metro Auto Wholesale in a locked lot and would be getting towed to them. Tony gave Jason an attitude and said that was fine but they would be picking up their vehicle.

01/12/08 Jason and Nicole receive a call from Metro Auto Wholesale stating that they were unable to obtain financing. They were going to refund the down payment of $500 and give them their trade-ins. After the phone call Jason checks his mail box.in the mail is a payment booklet sent from City Auto Wholesale. This was a complete total shock to both Nicole and Jason as they have never received any loan documents or heard from City Auto Wholesale since 12/29/07.

Jason then calls City Auto Wholesale to find out what's going on. Jason speaks to Tony, who tells Jason that they financed them in-house, they still had their trade-ins, and if they didn't receive $500 down payment they would Repo the van and Jason and Nicole would have that on their record. A call was then made to Metro Auto Wholesale. The ball was dropped so to speak and the trade-ins were never picked up as Jason and Nicole were told.

Jason then calls City Auto Wholesale to find out what the status of the van is since they were obviously financed for it, but have no vehicle. Tony then told Jason that since Jason had called on 12/29/07 to tell them he didn't want to go through them they had the work stopped on the vehicle. An internal timing belt was supposedly the problem. Tony was then asked if they knew we didn't want to go through them why would City Auto Wholesale still finance us. Tony said that is what they decided to do, and they were waiting to see if Jason and Nicole were going to actually make the payment and if they didn't they would just put it as a repossession and they wouldn't have to put any money in the car.

Jason was just bewildered by the answer he was given. Jason realized that City Auto Wholesale was trying to rip him and Nicole off. Jason asked where the trade-ins were, and he was told that they had already been sold. Feeling as if they were forced and stuck with this deal with City Auto Wholesale, they would have to make the down payment and then the 1st payment on February 2nd. Tony was told that they would be down there to bring the down payment and pick up another loaner until the work could be done on the van.

01/14/08 Nicole and Jason go down to City Auto Wholesale to submit the down payment and pick up the loaner vehicle. When they arrived they asked when they would get some word on the van. Jason and Nicole were told to give them a couple weeks and give City Auto Wholesale to check on it. Nicole tells Tony that an internal timing belt would possibly cause the engine to seize, in which the engine would be no good. She was told that it shouldn't ruin the motor and if a worse case scenario they would have a rebuilt or new engine put in. She then told him that she didn't want to make another status call in about a week to hear that the engine was toast, when she's already trying to tell them what the problem was.

01/25/08 Jason calls City Auto Wholesale to get status on the van. Tony says that they have been having problems locating an engine for the van. When Tony was asked how they were going to remedy the situation, he said they would get us into a new vehicle. Jason then asks that if he and Nicole only qualified for 2 cars on their lot, what were they going to try and give them now. Tony then says, Oh yeah, well then we'll just have to get you in a better loaner vehicle then (with a chuckle).

Jason then tells Tony that he feels highly uncomfortable with making a payment on a vehicle he has no paperwork on, is in some shop somewhere, and who knows if he would ever get the vehicle he was financed for. Tony then ends to say that if he or Nicole didn't make the payment then it would be a repossession on their record. Jason then asks what are they going to repo if there's no vehicle! Tony gives the most astonishing answer of, We'll just turn it in as a repossession no matter where the car is. Jason told him he just better do something to get the van fixed as they promised a month ago.

02/05/08 Nicole goes in to City Auto Wholesale to make a payment on the loan. A gentlemen in a desk by Tony asks her if she found the title. Nicole states that she wasn't looking for it, but had found it recently in a cleaning. He asks her if she could send it an sometime. She agreed that she would send it in when she had spare time, as it was hard enough for her to come out to Milwaukie already. He says ok.

She speaks with Tony about the status of the van. He tells her that they've still been having a hard time finding an engine for the Van. She then told him that the Mercury Villager is a discontinued model and that an engine would be hard to find, and that she was not comfortable with one being pulled out of a pick-n-pull yard. He agreed and said that they would find an engine new as they didn't want to waste putting money into an engine that would seize up again and they'd be back in the same situation. Nicole then asked if a replacement couldn't be found what would they do? Tony said well we'll get you into a better loaner vehicle with a chuckle. Nicole was upset and left their office.

02/10/08 Jason makes a call to City Auto Wholesale as they needed a bigger vehicle. The loaner given was a compact vehicle.

02/11/08 Jason and Nicole pick up a 2000 Town & Country Van.

02/16/08 Jason and Nicole receive a message from City Auto Wholesale in regards to sending the title.

02/17/08 Jason calls City Auto Wholesale and states they would try and bring it in over the weekend.

02/29/08 Jason calls City Auto Wholesale to ask for another status on the van. Mike then tells him that they still have not found an engine. Jason tells them that it was a Nissan motor, and didn't understand why Nissan couldn't be contacted for an engine. Mike stated that they had it taken care of, and if we didn't like the Town & Country he could come in for a better loaner vehicle until the van would get fixed.

03/07/08 Someone from City Auto Wholesale calls for the title. Jason told them that when Tony calls him he will speak to him, as we didn't understand why this title is being demanded from them, when it was clearly understood since 12/19/07 that the title was lost, and that they were going to be charged for the lost title fee.

Tony then calls Jason back to tell him that they needed the title. Jason then told him that he would need to speak to an attorney of sorts, as their attitude over a title is getting ridiculous, they had never received any loan documents for the van, they're making payments on a vehicle that is obviously not getting fixed as promised. Tony then stated that they would get him into a better loaner vehicle, and to just bring in the title when we had time. No mention as to ever getting any loan documents to Jason and Nicole.

03/14/08 Jason and Nicole receive another call for the title. Nicole then tells the gentlemen that if she had time over the weekend she would bring it in, but Tony told her to bring it in when she had the time. Nicole also told him that she was still uncomfortable paying for a van that is not getting fixed. He then said, Well you'll have to take that up to Tony, I'm just making a call.

3/17/08 through 3/23/08 Several calls demanding the title were made to Jason and Nicole. Nicole was very upset during the last conversation, and stated that if they had been charged $250 in a loan for a lost title and they have no paperwork for the vehicle, then it's obvious that City Auto Wholesale lied about those fees, as well as many other things. If City Auto Wholesale needed the title so bad, then why did it take from December 19th to February 5th to even ask for it? The gentleman had no answer to that, but just stated that they needed to title.

3/25/08 - Mike from City Auto Wholesale comes to the residence of Jason and Nicole demanding the title of the trade-in. Jason stated that Nicole was not home, and there would be no dealing of it unless they were both present. If Nicole had time after work he would try and have her drop it off.

9:25 P.M. Mike calls the residence of Jason and Nicole. Nicole answers and is immediately demanded to hand over the title of the vehicle. Nicole was very upset as no one should ever be spoken to that way, especially after all the dealings herself and Jason have experienced over the last 3 months.

Nicole then scolded him telling that she was never required to furnish a title, as Chuck was well aware on 12/19/07 that the title was lost. Chuck has told both her and Jason that they were being charged a $250 fee for the title of the vehicle. Mike ignored the fact and said, Oh well you knew we needed it since February and you've been avoiding us. Nicole said, If anything your company has avoided us with a truthful answer of our vehicle since day one, and we still don't have a vehicle that she was financed for. Well we gave you a loaner didn't we? Asked Mike. That is not my point, I am paying for a vehicle that I've never had, and now your calling me threatening me over a title that you knew was lost 3 months ago.

Mike continued to yell and scream at Nicole over the phone. Nicole was then fed up and stated, Don't call my home and harass me mother f*. She was very upset as she couldn't believe the treatment she was getting when she and Jason were being ripped off.

Twenty minutes later City Auto Wholesale calls again and Jason answers. Mike asks for Nicole and Jason states that she can not come to the phone but after that last call himself and Nicole will be there with the payment and title, and requesting the Mercury Villager to be there or the information on where the vehicle is to be furnished and hung up the phone.

03/26/08 Nicole goes to leave for work and the 2000 Town & Country was gone. As never receiving any letter of default or repossession as they were only 23 days late, and City knew why they hadn't been paid yet (due to the status and excuses of the Villager), Jason calls the police to report a stolen vehicle.

Realizing that after the harassing phone call the night before, that City Auto Wholesale must have towed the loaner vehicle. Jason arranges a ride to get to Milwaukie. When Jason arrives to City Auto Wholesale Tony remains sitting in his chair with a smug look and tells Jason that he had our vehicle repossessed because we refused to give them the title. Jason had the title and payment for the van, but Tony refused either one. Jason then asks for a letter of default and repossession, and Tony states that they didn't have to give him one.

When asked about the Lemon Law Tony stated that it doesn't apply to City Auto Wholesale, and they didn't have to do anything with the van. Jason then asked, Why did you make the agreement to take the van back, and repair it? Tony's reply was, Well we did, but you didn't furnish us with the title we want, and you didn't want to make a payment for a van you didn't have, so I repossessed it. When asked on how to get our possessions out of the loaner, Tony tossed a magnet at Jason and said that's who to call to get his stuff.

Jason asked one last question. Why is it that your report with the Better Business Bureau is so bad? Is it because you treat people this way and rip them off? Tony replies, No it's poor people like you who whine and cry about what their given. Jason just leaves in disbelief.

Jason makes a call to Set Towing at (503) 621-9720. A gentleman stated that he needed to get the keys for the vehicle and he would bring the possessions. The last call made to Jeff at Set Towing at 7:15 P.M.

03/27/08 Jason makes another attempt to get his possessions. Jeff states that he would be out for a while as he was in Beaverton/Hillsboro area. Jason receives a call at 9:35 P.M. From Jeff stating he would come by for the keys and bring the possessions. Jason told him it was awfully late to do it, so he would have to take care of it in the morning or afternoon the following day.

Jason and Nicole receive a letter of Repossession from City Auto Wholesale post marked on 03/26/08.

03/28/08 Jason receives a call from Jeff at roughly 7:35 P.M. Stating he would be on his way within the hour. Jeff never showed up or made a call.

03/29/08 Jason receives another call from Jeff at 5:15 P.M. Stating he was on his way. Jeff never showed up or called.

03/30/08 Jason leaves a message stating he was tired of getting the run around from both Set Towing and City Auto Wholesale, and wanted to get his belongings as one of the items was in infant car seat for his baby.

Jeff calls back with attitude stating he would charge gate fees and storage fees for our items. When Jason stated that he was shady from the beginning as we had a letter stating City Auto Wholesale has our vehicle along with the possession, and we had 10 days to get our stuff with out any fees. Jeff then stated he would be on his way to get the keys and bring the possessions once again. Nicole gave the keys to Jeff, and he stated he would be back shortly with the possessions. When Jeff comes back with the possessions and loaner vehicle he then demands for the title. He then stated that Jason and Nicole would only get their possessions if they handed over the title. Jason stated that was not part of any deal or in any letter. Jeff then stated that he will not be returning the possessions and drover away.

Nicole then calls City Auto Wholesale. When she asked who she was speaking to, the gentlemen refused to give her his name. Tony then gets on the phone, and when he's asked why she couldn't get her belongings, when the letter that was sent says nothing about a title being given in order to receive her possessions. She also stated to him that he refused to title on 03/26/08. He stated that she had still not honored her agreement on furnishing the title.

She then told him that City Auto Wholesale knew since 12/19/07 that there was a lost title, she was told by Chuck that they were being charged for it, and it was never mentioned until 02/05/08 that a title was needed but no rush. Tony then stated that Chuck had no right telling us that. She then told him that if was awfully funny that as soon as we stated we would be in there with the payment, title, and the demand of the actual financed vehicle, you had the loaner vehicle towed.

Nicole also mentioned that we still had no vehicle that they have been putting her off about for 3 months, no loan agreement for this van since they in-house financed them, and that she felt no one had any right to harass her for a title that they knew was lost over 3 months ago. Tony ignored her. Nicole asked him why he was ignoring her, and he stated what do you want me to say; you didn't furnish a title, so I repossessed your van. He then continued to say that until he got a title and full payment for the loan he would not give her stuff back. Nicole again stated that neither she nor Jason ever received loan papers, and Tony ignored her once again. Nicole stated she would see him in court, and he said Good Luck with a chuckle.
