Tried to SCREW ME out of job... Now, appears to want to SCREW ME OUT OF PROMISED pay restoration!

In April they decided that because I have Type 1 Diabetes, I could NO LONGER perform the job of Weighmaster, or any other job involving driving OR OPERATING ANY company vehicles or powered equipment.

I was FORCED to file charges with BOTH the labor union AND the EEOC in order to retain my job.

As a result of the filing with EEOC, Pilgrim's Pride responded stating they would RESTORE the vacation time I had to use to maintain an income during the time they had me removed from my job.

In return, they wanted me to withdraw the charges filed with the EEOC.

The Pilgrim's Pride attorney's, INSTEAD OF dealing WITH ME, gave the offers to the EEOC investigator, who RELAYED the agreements to me.

ONLY wording I EVER received was that "Since Pilgrim's Pride WILL restore my used vacation time, I will therefore be willing to withdraw the discrimination and other charges against them.

I received this message in August.

Ran it past the attorney working on my side...

He stated that "If the plant has made you feel they can be TRUSTED WITH YOUR LIFE... Go ahead and sign the withdrawal with the EEOC. If, on the other hand, the plant has given you ANY reason to doubt their willingness to follow through on their expressed promises... Do not sign anything until after they have actually restored the vacation time promised!!!"

my anniversary date of hire was 11-25... As of that date, they STILL HAVE NOT RESTORED the PROMISED vacation time...

How can I get Pilgrim's Pride Corporation to FOLLOW THROUGH on their attorney's negotiated settlement terms???

If they INTENDED to say "IF you will withdraw the charges, we will do THIS..." Then their attorneys SCREWED UP ROYALLY!!!

They SHOULD HAVE BEEN negotiating DIRECTLY WITH ME instead of stating their side to the EEOC, who was left to FREELY word/re-word the settlement terms with me.

The ONLY wording I ever received was "WE WILL RESTORE the used vacation time."

Yet now, A FULL MONTH AFTER my anniversary date-of-hire (By which my vacation time SHOULD HAVE BEEN USED)... Pilgrim's Pride Corporation STILL has NOT FOLLOWED THROUGH with their PROMISED SETTLEMENT TERMS!!!
