We signed into a contract w / James Russell on 4/3/07 to begin working on an addition to our home. The work began on 4/18/07.
For the first 2 weeks work was progressing great.By the 3rd week material was not arriving at the job, old roof rafters from partial demo was used to frame a door, 2x4's we had purchased for a small project of our own was used with out asking as the carpenters were instructed to use our lumber by their boss James Russell.
During this 3rd week we began to experience water leaks intruding into the interior of our home, a tarp was put on the roof during a heavy rain shower, but we still had water intrusion. The 4th week a small load of lumber arrived with 6 2x12x20 to be used as roof rafters/joist were damaged in the dumping with out care in the longitude was.
I called the contractor James Russell to complain of this and he assured me that the lumber would be replaced and new undamaged lumber would be used.
The lumber was never replaced, it was what I was told skiined w / 1/2 inch plywood which was supposed to go on the roof. We are also missing 3 roof rafters/joist. We were left w / a 2 foot section of floor open to the great outdoors where the addition meets the existing floor covered as intrusted by their boss with an empty box formerly containing vinyl siding, as well as a piece of non secured pressed board. We have dogs and cats, and the box because it was exposed to moisture from 1 weeks of rain 1 of our dogs stepped on the box and fell through the hole in the floor spraining his leg, our cats were getting out too. We purchased 2 sheets of pressed wood to secure the whole in the floor.
The last week the carpenters were here it was only 2 days, and the last day I witnessed the boss giving his workers tub&tilechaulking to use on the roof to secure the roof and pervent water from coming into the home. We continued to have water come into the home everytime it rained.
I asked James Russell for his insurance info on the same day, and he instructed me to contact our own insurance company and they would handle it. We have had our insurance company here to asses the damages and we have hired an attorney to help resolve this case, we have also had a structual engineer here at the request of our insurance company whom supplied us with a very detailed report of the damages incured, and defecinecies with the work. We can supply a copy of that report as needed.
As it is right now come colder months we will have no heat, we are looking at temp housing via a mobile home as the entire roof has to be removed, the front wall has to be rebuilt to line up the beam pocket with the existing post and beam which is off center of the house, where as their beam pocket is dead center of the house, being off 14 inches from the center of the existing post and beam. The door that was installed is not secured into the frame with any type of nails, or screws, just wedged in place with a piece of cardboard as a shim.
