Received funds 1.3 million from banks & home owners and didn't pay subs

Ideal Homes was owned by bill alvarez, bob adamo and brian martin. They sold the company in nov to Dean rossey sr. And Gary Oben.

In dec are company (sharp electric) sat down with the new owners and came to an agreement that they wiil pay us through a personal gaurantee (signed by oben) any past invioces in 4 equal payments starting jan 15. We also agreed that any new invioces would be paid within 30 days of invioce date.

Gary Oben then told us that if we did not accept this offer and continue to work on the existing ideal homes contracts then we would be put in the bottom of the barrel to be paid. We wanted to stay as close to our money as possible, we continued working for them.

The payments from neither the promissory note nor the new invioces never came. We were originally owed $33,000.00 and did another $65,000.00 before we demanded some money. We got 2 checks over the next several weeks. A check for @ $9,000.00 jan 23 and another for @ $12,000.00 feb 2. There are @ 50 sub-contractors that are owed money from Ideal Homes. There are @ 26 homes still under construction with home owners that have paid them, many of them that have been ripped off.

The story behind the new owners is that they have a DISBARRED attorney working as their CFO and he knows how to ride the gray area of the constructions laws. They have done this with other companies in the past, 1 in wisc. They are trying to "give" the company back to the origanal owners by saying that they hid monies and debt from them. They did have 4 seperate CPA's do an audit prior to buying the company and signed the due diligent clause. It was a stock purchase which means they bought debt and assets.

Some of the subs did file liens on the property but all that means is the home owners will have to pay twice. Most of them can't afford to pay the liens. The are forming a group to go after the builder.

The 50 or so subs have formed a group that has been meeting atleast once a week since mar 19. We as a group have gone to the newspapers & tv stations to get the word out that these guys are crooks. We have contacted our local sheriffs office, economics crime unit, local state atorney, county building officials and the state licensing board but they all have said that they don't want to get involved. Misappropiation of funds in the stae of Florida is a felony. If the dollar amount is over $100,000.00 it is a first degree felony. Florida statute 713.345

Our company, the home owners, the sub-contractors are seeking to go after these criminals, even if we have to go to the attorney generals office. They should be shut done immediately.

For those of you thinking about using any of these people mentioned be warned, they will rip you off too! If you are a sub-contractor and want to come in behind our backs and finished work that we have started for them, and haven't been paid, shame on you. You probaly won't get paid either.in the sporting industry we call them SCABS.

Gary Oben and Dean Rossey own Florian Gulf Coast Homes and have the same finacial trouble. They themselves are not licensed to contract in the building industry. Yet they act as if the are. Look them up through state licensing board and the don't even have a qualifier.
