WE are all a part of the Drivetime scam. It is true that most car companies ignore Drivetime reports when they show up on your credit report but I can not help but thinking how much crap they get away with.

I bought a 1995 Chevrolet camaro back in 2001. It rode okay, needed some help. I asked if the car had even been in a wreck. They quickly assured me that is was not.

Checked out the car and all was well. Went to pick it up and it had one of those car bras on, The sales man said he was thrwoing it in. I did not remember it being on before that. I did not think much of it. Drove the car home. It pulled to the left a little.

That night I wanted to clean it up and I removed the car bra, and wouldn't you know it the left front fender was dented inward pretty bad. I called the drivetime manager, I believe it was Chris. He said what dent. I showed him the car. He apologized and stated he would give it to his body man and couldnt understand what happended. I told him, it was not this way wwhen I purchased it. He stated he did not know what happened, he sent it out to be repaired and I got the car back a little over 3 days later. This time I got it back without rear speakers in the car. He b. S'ed me and swore it never had rear speakers. Which again, was a lie. SO I told him I wanted my money back, he said he could not do it. I was stuck.

About 2 months go by with both not agreeing with the stories. He claims he did everything to be a good customer service rep and that the car was never in an accident. I am driving home and a huge racoon makes me go off the road. I damaged the nose. I call my insurance company and they take care of it. I bring it to a body shop. The repair comes to me after the jobs dones and says, we did the best we can with what we had. I was like what? He said that this car was in so many accidents in the nose that the nose was garbage. He reccomended to buy a new nose to make it better.

I did not have the funds at the time, I told him that the car was supposedly never in an accident he said after laughing, its been in at least 3. I took it back to NOW DRIVETIME. And complained to Chris. I even called their corporate office and got the run around. I told them I wanted my money Back. I told them I would not pay another dime for this piece of garbage because they misrepresented the car. They lied. They claimed they did not. Well I called their office and said you know what, i dont wnat the $1000's I laready paid out for the garbage car, but was not willing to shell out anymore money into it. They said fine, that was ok.

I returned the car and Chris said dont worry, we will take care of it. They did, put it on my credit report as a VOLUNTARY REPOSSESION. This was in 2003. Its funny because they still are reporting it as an OPEN ACCOUNT with past due balances as close as August. This practice is not uncommon with scum companies such as Drivetime. They will soon find out, that I will have the last laugh. I can not disclose what (due to legal reasons and legal counsels advice) rest assured, the Kissimmee Drivetime will wish they did not cross this customer.
Bottom LINE is

They lied and misrepresented the car,
They assured me in fact still ahve legal documentation stating the car was never in an accident to the best of their knowledge.

Have all other documents proving that the car was indeed in accidents prior to me purchasing it.including one while it was being prepped for delivery which they hid with the car bra

Have equifax now involved in Complaint of improper credit reporting, since A) last activity is clearly before June but Drivetime is so hellbent with trying to screw with peoples credit that they are trying to refresh it monthly to claim it is an open and current account to which I was supposedly 90 days late in May June July and August. Although the car was clearly HANDED IN with the premise that the account was closed and satisfied in 2003.

GOOD LUCK DRIVE TIME... You will need it... The arbitration rule, That applies to OPEN ACCOUNTS, technically since the property for which the arbitration rule applies has been handed back to the company Drivetime and since the account is technically CLOSED since 2003 the arbitration rule DOES not apply. The FACT That they choose to use a credit reporting loophole and MISREPRESENT FACTS with their shady reporting ways will also catch up with them.

By the way here are the many rules that drivetime chooses to ignore

E) Indication of closure of account by consumer. If a consumer reporting agency is notified pursuant to section 623 (a) (4) [ 1681s-2] that a credit account of a consumer was voluntarily closed by the consumer, the agency shall indicate that fact in any consumer report that includes information related to the account.

Upon the expiration of the 180-day period beginning on the date of the commencement of the delinquency which immediately preceded the collection activity, charge to profit and loss, or similar action.

They obviously do not follow the rules of the government whcih states they can REPORT MY ACCOUNT AS CLOSED OR IN COLLECTIONS, (Which it is now) But they can not report it as DELIQUENT since it has far passed the 180 days since last activity. Nice try drivetime, But you will lose. You have lied over and over, you have hurt and misrepresnted and your own little legal loopholes you hide behind will become your undoing.
