The usual Nexiderm story (I now know...)

This is the letter I am sending to their corporate registered agent who is legally requires to give it to them.

To Whom It May Concern:

Let this serve as my last warning that Boehm-Ritter/Nexiderm shall not charge my credit card again and shall refund the fraudulent charges against this account.

My wife ordered the Free Trial of Nexiderm on December 23. My debit card was charged $5.95. My wife called the telephone number provided on the invoice to request an authorization number in order to complete the free trial and send the item back, as specified on the invoice, on both January 1 and 2. The number was repeatedly busy. She then sent, via the Nexiderm website request form, a request to send back the item and not receive any more charges.

On February 2, she received a package from Boehm-Ritter, which she refused and returned to sender. That same day, she called the (800) number provided by the company again, and was kept on hold for 30 minutes.

Since it appears that the business model of Nexiderm is to send expensive cream to customers who do not want it, and attempt in vain to cancel it, I see no other option but to file a lawsuit against Boehm-Ritter/Nexiderm in the Circuit Court of Cook County, where the incident took place.

Our phone records will be used to demonstrate our efforts to comply with Boehm-Ritter's arcane rules for avoiding charges. There may even the potential for a class-action lawsuit based on the impossibility of complying with the requirements of Boehm-Ritter. I'm certain we are not the only ones caused damages and loss of work through this problem. 02/04/05: $95.90
01/18/05: $89.95

As we have spent much time sending email and calling. Please refund the aforementioned charges forthwith and send a check in the amount of $500.00 for damages, if it the wish of Boehm-Ritter to avoid litigation. Please make check payable to Mr. X, XXX West 18th Street, #5, Chicago, IL 60616.
