FFL Holder ripoff

On June 6, I purchased a pistol from an on-line gun dealer for $299.00 plus shipping. I had the pistol shipped to a local FFL holder: Marc Boileau, Affordable Pawn & Gun Inc, 2750 Aurora Rd, Melbourne, FL 32935.

On June 17, I went to the pawn shop to pick up the pistol. I filled out the required paper work and Marc submitted it. It came back “Denied”. I asked Marc what I could do next and he didn’t know. I called the Florida Department of Law Enforcement and talked to them. They told me Marc should have given me an Appeal Form to fill out and send in. I went back to Marc and he didn’t know anything about it, but found the form in his files and made me a copy.

I sent the form in and on July 9 I received their response, the appeal was denied. I contacted Marc and told him. I asked whether I could find someone to purchase the pistol, bring them in to fill out the paperwork, pay the transfer fee, and let them take possession of the pistol. He told me that would be alright after 60 days, because after 60 days he could take possession of the pistol.

I found someone to purchase the pistol and went back to Affordable Pawn on September 9 to have her fill out the paperwork. She did and it was sent in. We waited 9 days and called Marc on September 18. He said the paperwork was approved and he would be at the Pawnshop at 4PM. We went to the Pawnshop and waited until 4:45PM. He never showed up and didn’t answer his phone.

I called him on September 19 and got in touch with him. He told me he had decided not to release the pistol because he didn’t feel comfortable with it.instead, he told me he would list the pistol for sale on GunBroker.com and when it sold he would reimburse my money. I told him that was alright with me.

I have been monitoring GunBroker.com since then and have not seen the pistol listed. Since this whole thing started, I have been calling him to inquire about things and he has NEVER returned any of my calls. I have also emailed him and he did not respond. I finally got in touch with him on September 30 andf he told me he had listed the pistol for $299.00 and had not gotten any bids on it. I told him I had not seen it listed. He said he would list it again for less and let me know what the Item number was so I could track it. I have not heard from him since and still have not seen the pistol listed on GunBroker.com.
