Subject: Raymond Lester URGENT!!!

Dear Mr Lester,

It’s a month now since my last e-mail and no reply from John Boyle

Evertex Coatings regarding the faulty rendering on our cottage.

We have been using santex paints for years and never had this type of problem before.

Certification we were promised 15 years guarantee from Evertex???

Why are we having all these problems? After all we do have a guarantee for 15 years

Don’t we?

We are not asking for anything that we have not already paid for just for the work to be finished and not to be bullied and threatened and accused of stealing paint to paint our porch.

We have CCTV footage to prove they did the painting themselves with dates and time.

When an organization like NSAI has a register of companies on their books claiming to be qualified for external insulation then there should be a regulatory body to over see the work and see that it is finished to a high standard.

My Wife suffers with her nerves and this added stress has nearly put her over the edge.

I just hope that commonsense prevails and Evertex develops a conscience and put things right so we can get on with our lives and enjoy what is left of it in peace.

Why was this product passed by NSAI and SEI if it is faulty? And only lasts two years?

Example:

Step 4
A low maintenance coloured and textured acrylic render finish is then applied (troweled or sprayed). There is an extensive pallet of colours and textures to choose from. The final result is a durable low maintenance finish that will only need hosing down to clean every 3 to 5 years. (As the finish has a 1% fade rate in a 10 year period, accent colours might fade slightly.)

Low maintenance this is totally false in less than two years we are into high maintenance nightmare with no backup or support from Evertex so much for

Promises and so called guarantee’s by Evertex.

We are disgusted with your product and would not recommend it to anyone

I watched the plasterer Seamus from Evertex and when he was finished it looked

Fantastic nice textured finish two days later it was a mess.

How long does this render take to dry a week or two?

Seamus said it would be hard in 24hrs but not so.

I can be contacted any time by e-mail which is regularly checked each day.

Trusting you can now bring closure to this very stressful two year nightmare

By putting things right.

Yours truly,

George

James,

Parex Warranties cannot be issued more than 1 year after projects have been completed, however there can be exceptions in writing to Parex USA. There is no record of any warranty being applied for this project.

The warranty cover 10 years and the stated 15 years is not on offer from PAREX, find quoted text of typical warranty.

"Parex USA, Inc., hereinafter referred to as the Manufacturer, warrants that the products it manufactures, as components of

An exterior insulation and finish system (EIFS), when installed by a currently listed applicator who has attended the

Manufacturer’s EIFS Education Seminar and in accordance with the Manufacturer’s written guidelines, specifications and

Details in effect on the date of installation, will be free from defects in material and manufacturing for a period of ten (10)

Years from the date of completion of the installation of the Parex Standard EIF System.

This limited express warranty is exclusive and in lieu of all other warranties of any nature

Whatsoever, whether oral, written, express or implied or imposed by law, particularly in lieu

Of the implied warranties of merchantability and of fitness for any particular purpose without

Limitation, in no event shall the manufacturer have any liability arising out of errors or

Omissions, or relating to the design of the construction on which its products are used, or

Based on negligence concerning the use of the product.

Defects caused by accident, abuse, misuse, mishandling, shipment, improper storage after shipment, freezing or abnormal

Conditions of temperature or moisture, improper substrate, improper or defective application, improper combination with

The other products of the Manufacturer or with the products of third parties, failure to comply with the Manufacturer’s

Instructions and advice, or inadequate or defective architectural or engineering designs of others are not warranted under

Any circumstances.

The exclusive and sole remedy for any breach of any warranty whatsoever shall be that the Manufacturer will supply

Conforming replacement products and cover the labor costs of repair by an applicator currently listed by the Manufacturer

If it is shown that the products manufactured and sold by the Manufacturer were defective when originally supplied. Discovery

Of alleged defect covered by this Warranty shall be made in writing to the Manufacturer within 15 days to the Claim

Department after which the Manufacturer shall be provided with a reasonable opportunity to review and investigate the

Alleged defect.

The manufacturer is not liable for any incidental or consequential damages of any kind, whether based

On warranty, negligence, contract, tort, strict liability or any other theory whatsoever.

The warranty is issued to the General contractor, Builder or Owner of the building and may be transferred to

A subsequent owner during the term of the warranty providing the Manufacturer has been notified in writing

With in 90 days of the legal transfer of the property. Since the goods are building materials and are not

Intended to be sold to a “consumer” except as part of real estate, this warranty is not intended to apply to

Any party constituting a “consumer” as defined by the Magnuson-Moss Warranty Act.

The Parex Standard EIF System requires periodic maintenance. It is the owner’s responsibility to perform

Necessary maintenance. Failure to follow the maintenance procedures, such as inspection and repair of

Sealants, flashing and roofing, will result in voiding this warranty.

This warranty is null and void unless the Manufacturer has received payment in full for such products subject

To the warranty."

Algae is quite common espicially in this weather, there are additives in the acrylic render to resist algae and moss growth however with the best will in the world there would be no such finish as a algae resistant external finish. External Wall Insulation would be quite prone to algae under the right conditions due to is lack of Thermal Mass. There would be many dwellings completed with the same batch of acrylic finish and have not got any issue with algae forming on the surface, this would be due to building orientation and surrounds. It is quite common in facads facing the north west and north.

Find below text for the maintenance of algae on the surface of Acrylic finish.

· Mold, mildew, and algae are microorganisms that can grow on virtually any surface if the conditions are right. If this growth appears on the surface of the EIFS finish, it can be cleaned and removed. Commercial cleaners designed to remove mold, mildew, or algae are available. Alternatively, a solution of one part household liquid chlorine bleach to five parts clean water may be used. Apply this solution to the wall with a soft, non-metallic bristle brush, then rinse the wall thoroughly with clean water to remove the bleach solution. If you are unsure of the results of either method, test a small area first.

· Pressure Wash

Pressure washing is an ideal way to quickly clean your exterior wall and regain its original look. Pressure should not exceed 1,000 psi. The washer should be held at least one foot from the finish to avoid possible damage, and the operator should keep the tip of the washer moving.

The quality of the works need to be inspected and I can arrange to visit in the coming weeks, unfortunately my dates are not available due to prior arrangements and appointments.

I can also arrange to speak further with John of Evertex on the matter.

Anything further please contact me.

Regards,

Raymond Lester

John Boyle Evertex Coatings 2010 — 2013.

Many thanks for your phone call received this evening.

John you know where the cottage is and what the problem is so drop out any time and take your pictures.

The Man you sent out Seamus is a very good plaster and his work is the best I have seen in a long time. The one big problem is the weather a lot of the finished work has moved due to the bad weather we experienced...

The render is slow drying and can take days to dry and if it’s a wet windy day then we are back to square one. If you can send Seamus back the next fine day then he can touch up the render that moved with the wet.

The next big problem we are now facing is the changing colour of the paint work from classic cream to green. The green will not hose down and if we use a power washer there is a danger of stripping off the render.

The next problem that needs to be addressed is the problem of certification we were promised 15 years guarantee from Vernon Brown your project manager on the 19th of October after he signed the declaration of works form.

Acrylic render finish

A low maintenance coloured and textured acrylic render finish is applied (towelled or sprayed). There is an extensive pallet of colours and textures to choose from. The final result is a durable low maintenance finish that will only need hosing down to clean every 3 to 5 years. (As the finish has a 1% fade rate in a 10 year period, accent colours might fade slightly.) This is not true come and see the fade rate for your self.

This is not a durable low maintenance finish that will only need hosing down to clean every 3 to 5 years. It’s a nightmare GREEN that will not hose down.

Trusting you can address the above and 2013 will be an end to the matter.

Yours truly,

George
