Many months ago, I agreed to puchase on lay-away, from an internet site, a mobility scooter, whose original price was near $1800. This is a motorized (electric) chair with a large seat, capable of going 18 miles per hour, which I bought since I am disabled and since have had my left foot amputated. I am somewhat ambulatory, but depend on such devices to go any distance. My idea was that this chair would be good for those short trips that each of us has to make, such as to the corner store, the post office, or just take the dog for a walk.

I contacted the company, at http://www.omegastores.com/, authorized them to take the $50 monthly lay-away charge from my checking account. On the second month, they withdrew the complete $1800, overdrawing my bank account. I contacted them, and after some confusion on their part and another week's delay (and several bank penalties to my overdrawn account because I had already written checks for the Rent, Electricity, etc., which were presented for payment), before I knew the $1800 had been taken.

They refunded the payment, but did not refund the penalties their error caused.

After some months, I contacted them, asking what my complete balance was. The told me $1491.44. I paid them the balance in full, on 09/27. They did not deliver, but sent me an email, and a note in the mail saying their supplier has sent a wrong part, but in compensation, they would give me a two-year warranty. It was not until 12/06 that they wrote me a purchase invoice and on 12/12 the machine was delivered by UPS freight.

It was damaged severely. There were four holes in the shipping container, which I now propose were put in it by a misplaced fork lift tine. The person who assisted me and signed for delivery, did not know to check for external damage to the shipping box.

Upon opening the shipping pallet, the scooter cowel, or body, fender, covering, etc., had several cracks, multiple serious scurf marks, a displaced rear light, and a twisted front tire and steering mechanism. The unit is unusable. I placed the broken unit in my garage to protecte it intact.

I contacted the seller, who told me to contact UPS and make a freight damage claim. I did so. They sent an inspector about two weeks later, who took pictures and left, telling me he would email me his report.

For reasons not explained, the claim was disallowed.

I called the seller, and emailed the seller, and repeatedly contacted them by email, and have first, no positive response from them, then no response at all. They have not answered my last five emails except by a form message which says they would answer within 24 hours. They have not, repeatedly. My contension is that they sold me ax expensive scooter, but did not deliver it in usuable condition.

I have ample documentation for all of these facts and am prepared to email them to you if you request them.

I think I am a victim of shoddy practices, or fraud, or perhaps theft, from this company doing business in Connecticut.

What advise, or help can you give me.
